Secular Indians are exposed with the Christian and Mohammedans mournings and celebrations: Till 1980s, Indians of secular or of other nature did not know much about the mourning or celebrations of Mohammedan and Christian festivals and remembrances. Many times, innocent Indian used to think that “Good Friday” is a very good and auspicious day to celebrate and enjoy. But, slowly, they come to know that it is a day of mourning, as the Christian God was reportedly crucified and died on the crosss. Ramzan draws attention nowadays, because of media coverage and secular appeasement in India. Even if 12% Mohammedans in India celebrate or do not celebrate, according to their belief-system (as some events are to be mourned and no celebrated), holidays would be declared and media dump all sorts of narratives selected and thrusted on the 88% of the rest of India. In India, generally, celebrations, festivals and commemorations would be of merriment nature and not of mourning, grief and bereavement. In fact, even “Naraka caturti” is celebrated and not mourned. Under such circumstances, about Ramzan, much fuss is made. In Jammu and Kashmir context, “Ramzan ceasefire” is talked about, though, daily, jihadis kill people and get killed without any remorse. Perhaps, they do not have any Ramzan or fasting. Or they serve Allah by killing humanbeings or kafirs or Mohammedans themselves on one or the other pretext. Thus, the news of throat slitting of four years daughter by a devout Muslim father haunts and daunts Indians now.

So, it has to be decided by the believers to suit the theology.

Gruesome throat slitting of four years baby – girl child: Jodhpur Rural police on Saturday 09-06-2018, arrested a 26-year-old man, a resident of Silawaton Ka Mohalla for allegedly murdering his four-year-old daughter, a day after she was found dead at their home[1]. Nawab Ali Qureshi’s daughter Rizwana was sleeping with her parents and an 11-month-old sister on Thursday night, when she was found murdered[2]. The family, which lives in Pipar City, approached the police with Qureshi’s wife Shabana (22) submitting a complaint[3] about her gruesome killing. Considering the “sensitivities, and heinousness of the crime”, Jodhpur Rural SP Rajan Dushyant constituted multiple teams to probe the case, while teams from Forensic Science Laboratory and dog squads were also brought in[4]. In a secular India, nowadays, everytjing is interpreted differently, according to one’s convenience or ideology. “Investigation revealed the suspicious role of the father. His psychological questioning helped reveal clues. Ultimately, he confessed to his crime,” the police said in a statement.

The father-killers confessed that Satan / devil possessed him and he sacrificed his daughter: The SP quoted Qureshi as saying, “Jo meri sabse pyaari cheez thi wo Allah ke paas bhejni thi (I had to offer my most prized possession to Allah).” As per Islam, the month of Ramzan is observed to practice tolerance and selflessness. Qureshi told the police that he believed the devil had entered him / Satan had taken over him[5]. India Today noted[6], “He also said that now he is in a state of shock and feels as if Satan had overtaken him when he murdered his daughter. If he were to be believed, the devil got it done and not him.” In resemblance of sacrificing a goat on Bakrid, a man slit throat of his four-year-old daughter to please Allah during Ramzan[7]. “I am a devout Muslim and love my daughter more than my life. For several days she was at her grandmother’s place and returned on Thursday. I took her to the marketplace and bought sweetmeats and fruits. In the night I took her to the courtyard downstairs, recited a kalima, killed her, and then went back to sleep upstairs,” Qureshi told the police[8]. Rizwana’s post-mortem and burial took place on Friday, 08-06-2018[9]. So the PTI news[10] is repeated by other English print and electronic media that “to appease Allah,” the sacrifice was carried on! So no secular Indian can have any right to condemn or criticize.

How can secular Indians understad that Allah can be pleased by killing four years daughter?: So far, secular Indians have been witnessing how camels, cattle and other animals and fouls are sacrificed during the “Bakrid.” No “Blue cross,” PETA or any animal loving agencies, groups or individuals comment upon r criticize such killings with blood flowing on the roads. Some times, news would be there like, the meat shops would be closed on “Mahaveer Jayanti”! That is by one day closure, all have been made to believe that all meat-eaters respect on the rest 364 bdays. An ironically, nowadays, all types flesh eaters participate and even lecture in non-violence, vegetarian and other “Jeevakarunya” type meetings, seminars and conferences. On the worst side, NV food is also served on such occasions. Many times, intellectuals and ideologists claim that “The sin of killing (of anything) is neutralized by eating it (its flesh)”

Madurai church attack - Miscreants vandalize church

Pentecostal Church attacked in Madurai 11-03-2018: The incident happened around 9.30 am when priest Ravi Jacob was taking part in a prayer session. “A gang of 50 men led by a religious outfit leader”, protected by a gunman, entered the church and started attacking M. Ravi Jacob[1]. A prayer home of a Pentecostal church in Sikkandar Chavadi here was vandalized and copies of the Bible were burnt, allegedly by members of a “Hindu right wing group”on Sunday 11-03-2018[2]. Another report says, “Some members, reportedly of the same group”, later went to three other prayer homes belonging to Pentecostal church in nearby areas and verbally abused the pastors and worshippers and threatened to attack the homes if they were not shut in a week[3]. Jacob, the pastor at the Sikkandar Chavadi prayer home, which is a branch of Rhema Church, said more than 10 people, including a person who had an armed policeman as his Personal Security Officer (PSO), came to the prayer home in the morning[4]. “I, my wife, two children and a few others who had come for the prayer were there. The men used abusive language and roughed up me and my wife,” he said. He alleged that they later took out copies of the Bible present at the home, along with his mobile phone and a few other belongings, and burnt them in the street[5].

Christians accused “Hindu Munnani” for attack: Corroborating his allegations, the family who owned the place, which is a small tile-roofed structure in a narrow lane, said the pastor had rented the place a couple of months ago and visited it on Sundays for prayer meetings. Jerome Jegatheesan, pastor of ‘Bethesda Varthaiyin Jeba Veedu’ prayer home in Koodal Pudur, said a group of people visited the home a couple of hours after the incident at Sikkandar Chavadi. “They abused us in filthy language and asked us to stop our activities,” he said. Sasi Sugathiya, a pastor with Living God Church, said two other prayer homes in Koodal Puthur area were also threatened on Sunday. The video of the group threatening one of the prayer homes was uploaded on Facebook by a person claiming to be a Hindu Munnani member. However, there is Christian  material and burning them, but, there was no commotion, as everything was going on the road and the event was evidently recorded ny many [6]. It is appears strange, as the attacker himself to present evidence to the public to prove that he attacked or involved in such act. This is similar to earlier NDTV propaganda about the Gujarat riots where, the Hindutwa group heads were depicted as “claiming themselves with pride that they indulged in such violence.”

Police version of the attack: N. Manivannan, Madurai Superintendent of Police, said a case had been registered based on Ravi Jacob’s complaint against 10 unidentified Hindu Munnani cadre. He, said, “We have identified three persons involved in the incident. However, we are yet to arrest any of them.” On the presence of a PSO, he said the police were yet to confirm that. “If a PSO was present, it will make the identification of the accused easy,” he added. Stressing that there were no attacks on the other three prayer homes, Madurai City Commissioner of Police Mahesh Kumar Aggarwal said the group appeared to have threatened the pastors to close the homes by claiming that they did not have permission. “We have registered cases and appropriate action will be taken swiftly,” he said.  However, it can be noted that politicians like Vaiko accused police that they have registered a case against the “unidentified” persons. Therefore, it is evident that the issue of “illegal churches” has been converted into “secular” and “communal” one.

Madurai church attack - Notices to illegal prayer halls- TOI

30 prayer halls in Tamil Nadu receive notice, HC stays closure of one (October 2017)[7]: District authorities have issued show-cause notice to about 30 Christian prayer halls in Coimbatore district alone, threatening to close them down for conducting prayers without prior permission. But, the Madras high court came to the rescue of one such hall, when it stayed a notice issued by a jurisdictional tahsildar to a Sulur-based prayer hall. Concurring with the submissions of P Wilson, senior counsel for the prayer hall, Justice K Ravichandrabaabu said: “The court is of the prima facie view that the petitioner is entitled to an interim relief of stay for a period of four weeks subject to the condition that under the guise of conducting prayers the petitioner shall not cause any nuisance by way to the public.” The judge then ordered notice to the tahsildar concerned and district collector returnable by four weeks. Though Selvasingh Samuel, 37, who is pastor of a prayer hall at Sultanpet in Sulur taluk in Coimbatore district, won the relief for his prayer hall, the pattern as per which the notices were slapped on similar prayer halls in the region is unmistakable. Some of the notices were identical and referred to complaints and apprehension of public order disturbances in the regions concerned. They also raised the bogey of prayer being conducted without prior permission from authorities[8].

Permission given for the construction of a residential house and not for any jamath/prayer hall/madrasa (November 2017): The activists said the complaint was a ploy so that some organisations could continue their “illegal conversions”. Police said they had received complaints from the public that some prayer homes were being running illegally and demanding that these be closed[9]. Incidentally, the Courts have delivered judgments in recent years about the construction of prayer halls, usage of house for conducting prayer etc. In one case, the judge said it has been categorically stated in the stop-work notice that the planning permission was obtained for the construction of a residential house and not for any jamath/prayer hall/madrasa[10]. When there was a specific plan accorded for construction of a residential house, the petitioners cannot deviate and hence the panchayat was right in issuing the stop-work notice and thereafter passing the impugned order of cancellation of planning approval. Proceeding with construction and claiming investment of huge amount on the same cannot be a ground to permit the construction of superstructure to stand there, the judge added[11]. Therefore, if anyone follows the secular rationale of the cases, it has to be applicable to all. However, the secular and Dravidian politicians have taken different stand of accusing the right wing group for the attack.

This was not a law and order problem, but denial of right to worship and destruction of secularism, the Constitution and democracy, Council president Anthony Pappusamy said in a statement[13]. Meanwhile, the Tamil Nadu Latin Bishops’ Council had condemned the attacks and said it was an effort to “chase away” Christians who had a fundamental right to worship. This was not a law and order problem, but denial of right to worship and destruction of secularism, the Constitution and democracy, Council president Anthony Pappusamy said in a statement[14]. A clip of the group reportedly threatening the persons has gone viral. A case was registered yesterday against 10 Hindu Munnani activists, of whom three have been identified. They said some of the activists, during initial questioning, denied that they had attacked the homes and had only staged protests against persons being allegedly lured for conversion. The activists said the complaint was a ploy so that some organisations could continue their “illegal conversions”. Meanwhile, the Tamil Nadu Latin Bishops Council had condemned the attacks and said it was an effort to “chase away” Christians who had a fundamental right to worship.

Pressure brought on the media to silence: Indian Currents, a 21-year-old publication by Catholic Church has withdrawn its cover story ‘Cardinal Sin’ “under obedience” by its chief editor Dr Suresh Mathew[1]. They had probed the land dealings by their internal team against Cardinal Mar Alencherry, the major archbishop of Syro-Malabar church. Indian Currents is a weekly news magazine published from New Delhi under the patronage of the Capuchins of Krist Jyoti Province of North India which gives in-depth analysis of day-to-day events in the socio-political and religious fields. Usually, Dr Mathew uploads the online version as early as Saturday morning when the hard copy hits the newsstand on Monday. Just when the matter was going to press this Saturday morning, he got a call from his provincial house to withdraw the cover story, an editorial by himself and the corresponding article written by Fr Jose Vallikkattu, a missionary priest belonging to the Missionary Society of St Thomas (MST). However, in this case, he had to face the Church differently.

The article published was withdrawn: “As a priest, I should be obedient. When I received a call and an email from the Provincial House asking me to wait until the internal probe is over, there is nothing I can do but withdraw at the last moment. So I have been forced to withdraw all the articles on Cardinal Alencherry’s land deals that have landed the Archdiocese of Ernakulam – Angamaly in a mess,” he told DC[2]. So Catholic priests have to cover up the crimes, sex and financial scandals and all in the name of god and save honour. But now he and his editorial team have been forced to come up with Bhima – Koregaon violence in Maharashtra where he has asked political activist John Dayal and senior journalist A. J. Philip to come up with articles on a war footing. His hard-hitting editorial states that “there is more to the episode than meets the eye”.  He recalls the words of Cardinal George Pell, Vatican’s prefect of the secretariat for the economy, who had opined a few years ago that the “next wave of the attacks of the Church could be for financial irregularities” which has since been proved right, though the expert committee’s probe is on. The detailed cover story states that “with the latest land row, however, the church has run itself the risk of losing the trust of its congregations. In fact, a church that was built on the solid foundation of unity is today divided in opinion”.

The issue of black money also comes up[3]: A church panel probing land transactions in the archdiocese of Ernakulam has recommended action against Cardinal George Alencherry under Church and civil law for causing losses to the diocese. This is the first such recommendation — the case also involves black money — for a Catholic Church in India. Alencherry is among the Indian cardinals eligible to elect the Pope. The church panel report has been sent to Rome. Ernakulam archdiocese spokesman Father Paul Karedan admitted the probe report contained grave charges against Alencherry and said the report would have reached the Pope by now. “We have sent the report to Rome via the Apostolic Nuncio (Vatican representative) in Delhi,” Karedan said. Two others were also blamed for the land deal. Last month, January 2018, the archdiocese had appointed a six-member panel, comprising priests and laymen, to probe losses suffered by the archdiocese in dubious land deals since April, 2015. Alencherry’s secretary and church spokesman Father Jimmy Poochakkattu said the Cardinal would not react now. “He will bring out a circular in which he is expected to explain everything. It will be read out in churches under the archdiocese,” he said.

The Church Report confirms financial scam[4]: The losses were incurred after the sale of five plots owned by the diocese in various parts of Ernakulam district. The diocese should have received at least Rs 27 crore from the sales, which they needed to repay bank loans, but received only Rs 9 crore after the dubious real estate deals. The report stated, “There is grave violation of the Church laws, which amounted to naked act of breach of trust and criminal misappropriation of properties.’’ The probe committee also found unaccounted money, which it termed a “grave issue”. “Total amount receivable according to 36 deeds is Rs 13.52 crore. But, there is a difference of Rs 13.62 crore between the documented amount and the amount in the curia (a diocese body) resolution. Receiving unaccounted money is a serious offence as per the Income Tax Act.’’ The church panel report stated: “The Major Archbishop (Alencherry) was directly involved in alienating all the five plots, which were sold after being divided into 36 pieces. The first deed was registered even before it was discussed in the Consulters’ Forum. Decision of the finance council quoted in all the 36 sale deeds is incorrect. The receivable value set by the diocese was Rs 27.15 crore, whereas the value according to the registered deeds was only Rs 13,51,44,260.” The report also noted that the diocese only received Rs 9.13 crore from the “agent”. “It is painful to note that at the time of execution of the sale deeds, Alencherry has not assured the receipt of money to the archdiocese.’’

Violation of Church law and civil laws along with the lack of transparency and collegiality: According to the report there were “numerous instances” of violation of Church law and civil laws along with the lack of transparency and collegiality. “As the head of the Syro-Malabar Church, Alencherry should have taken utmost care in respecting the provisions of Church laws,” the report said. Two others from the Church – priest Sebastian Vadakumpadan and the finance officer Joshy Puthuva – were also blamed for the dubious land deal. The report also named Saju Varghese Kunnel as the kingpin in the deal and alleged that he enjoyed the confidence of the Cardinal and father Puthuva. Without naming the Cardinal, the committee recommended, “People who are responsible for the crisis should be tried according the law of the Church and necessary action should be taken for the violation of the civil law.’’

Where the money has gone?: The report stated that the registration of land deeds took place in violation of all norms even without receiving the entire amount from the sale. The committee found that the value of the land was Rs 4.47 lakh per cent but the archdiocese fixed this at Rs 9.5 lakh per cent. One cent is equal to 435.5 square feet. The report has blamed Alencherry for involving Kunnel in the transaction, but the former claimed he who introduced Kunnel to the finance officer Puthuva, who in turn said he acted under Alencherry’s instructions. The committee also evaluated that the diocese has lost Rs 46 crore in various land purchase and sale deals since April, 2015. Though the price fixed for five plots was Rs 9.5 lakh per cent, the then prevailing market rate was Rs 15 lakh per cent. Secretary of priests’ council Father Kuriakose Mundadan said the council had discussed the committee report on land dealings. “Alencherry informed the priests that the council would have an elaborative debate on the report later. The meeting of the pastoral council, a body of priests and laymen, would be held after the detailed discussion on the report in the priests’ council,’’ he said. Karedan ruled out chances of Alencherry’s resignation. “He has told the priests that he would give explanation for all the allegations after studying the report. He has reservations about some of the findings in the report. He has sought some more time to explain his stand,” he said.

All Indians, who violate the Acts and Rules should be brought to book and get punished: Indians can be kept quite as this is related to Church and so on, but, the violation of law of this land is different from their internal hushing and covering ups. Just like “Katta-panchayat”, they have been concealing many crimes. Abhaya murder case is almost forgotten. Therefore, these violations cannot be simply treated as were “numerous instances” of violation of Church law and civil laws along with the lack of transparency and collegiality. Just because, they have power, money and above all, all suppressing and oppressive capabilities, even God may not forgive their sins. Even in this case, as they have crossed all the limits, their own believers have taken action to punish the guilty and bring under the law of this land.

Pannerselvam rushing to Delhi to seek an ordinance to overturn the ban[1]. In December, 2016 the court had reserved its judgment on a clutch of petitions that challenged the central government’s notification in January 2016 allowing bulls to be used in JallikattuAs an interim order, a bench led by Justice Misra had on January 13, 2016, stayed the Centre’s notification, due to which the apex court’s original order of 2014 banning Jallikattu is still in force. [2]. How all these processes took place, why the involved kept quite, delayed or played safe and all are debated again and again. Later in the evening of 20-01-2017, the Centre cleared the final legal hurdles in holding Jallikattu in Tamil Nadu over the weekend by approving the state’s draft Ordinance. The draft Ordinance, which will add a state-specific exception in the 1960 Act, passed through four ministries during the day — Environment, Animal Husbandry department of Agriculture Ministry, Law and finally Home — receiving consent from each within hours. Again, it proved the hasty, urgency and injudicious act to settle the issue. In its comments on the draft, the Environment Ministry, which administers the Prevention of Cruelty to Animals Act, is learnt to have taken the view that Jallikattu had to be viewed in its cultural context, and that a decision on banning the sport could not be purely legal in nature. The last nod had to be given by the Ministry of Home.

ops-modi-jallikattuNow, it is clear that the issue is political: The final clearance of the Ordinance by the Home Ministry came just a day after Tamil Nadu Chief Minister O Panneerselvam met Prime Minister Narendra Modi and urged him to find a legal solution to the issue. Panneerselvam postponed his return to Chennai on Thursday (19-01-2017) and stayed put in the capital till Friday (20-01-2017) morning as his government prepared the draft Ordinance and handed it to the Centre. Top Tamil Nadu officials made the rounds of different ministries to hold consultations and decide the final language of the Ordinance that will put bulls on the list of performing animals in the state. A group of MPs from the state, led by Lok Sabha deputy Speaker M. Thambidurai, also met Home Minister Rajnath Singh and Environment Minister Anil Madhav Dave to press for the Ordinance. Whether the AIADMK was playing its internal politics or otherwise, the gameplan involved was exposed. With the Centre drawing flak, BJP sought to project that its government was actively engaged in resolving the issue[3].

The anti-Modi placards, sloganeering etc., are inexplicable: It is evident that sizable crowd of the “Jallikkattu” protesters were not students, but members of the radical groups like ma.ka.i.ka and its associated organizations. All the fringe Communist  clusters also joined. The Muslim presence could be noted. Thus, the anti-Modi placards, sloganeering and shoutings appeared intriguing in the context. That too, several placards carried very vulgar, indecent and unparliamentary words and expressions. Why, how and for what purposes, they used, only, they have to explain. But, definitely, such aberration marred their cultural claims made on the civilization, heritage and tradition in the name of Tamil, Tamils and Tamilnadu. The separatist sloganeering also exposed the involvement of fringe elements. Asian Age reported that[4], “Prime Minister Narendra Modi’s rejection of the state’s demand for a Central ordinance on jallikattu has triggered widespread anger in Tamil Nadu”. Residents geared up for massive protests on Friday (20-01-2017), with all sections of people joining students and youth fighting to save its traditional sport and preserve Tamil culture. Furious jallikattu protesters widened the canvass of the protests to include all issues in which the state’s rights were trampled. One of the students, Senthilnathan, who had gathered at the Marina asked, “If Narendra Modi is so concerned about respecting the Supreme Court, why had he opposed the apex court’s verdict to form the Cauvery Management Board?”.

The protesters also targeted the railways blocking the trains in several parts of the state. Traders associations announced a total shutdown on Friday and cinema theatres would remain closed to express support the agitations. The Marina continued to be the epicentre of agitations for Tamil pride with the gathering of youth reaching about 90,000 for a stretch of about three kilometre on Thursday (19-01-2017) evening. The sound of waves were drowned by slogan shouting and drum beating youth, who supported jallikattu and demanded a ban on Peta, which was instrumental for jallikattu ban. There were hundreds of protests throughout the city, besides the agitations in every district and taluk of Tamil Nadu. The southern districts continued to vibrate with jallikattu protests centred around the historic city of Madurai. Besides boys and girls, children and working and housewives too joined the agitations throughout Tamil Nadu, voicing their anger against the unjust treatment to Tamil Nadu on a range of issues from the massacre of Sri Lankan Tamils to the non-formation of Cauvery Management Board[5].

anti-modi-demo-2017Chennai had two faces in the “Jallikkatu” shows and bandhs: On 20-01-2017, the worst sufferers had been the office goers, regular teavellers and some students who attend private professional institutions. Autos and call taxis kept off the roads even as few government buses plied on the roads with improper announcement[6]. That the Banking operations took a hit with workers taking part in protests and Employees of various IT companies held placards and banners with slogans against NGO People for the Ethical Treatment of Animals (PETA) etc., appeared artificial, perhaps, they  too wanted publicity or showed them to be supporting for the cause with the vested interests. The “Jallikkattu” protesters purposely occupied the most-crowded junctions, bus-stands and such other places, just to get the attention of others. This only created nuisance at morning and evening hours. Many inter and intra-state trains were fully and partially cancelled while some others were diverted. The suburban EMU services ran late. In Chennai, all roads led to Marina beach with men and women, clad in black, besides children joining the protest that has transcended political and other differences. Though, the schools and colleges did not function, as leave was given to them, the office goers and regular travellers of buses and trains suffered heavily and the autos fleeced them as usual taking the opportunity.

Shah Bano and Jallikkattu: How BJP has gone in the Congress way to bend the law!

Venkaiah Naidu citing “Shah Bano” case precedence (10-01-2017)[1]: Venkaiah Naidu hinted that in the view of strong emotional connect of the people of Tamil Nadu with jallikattu, the Centre was mulling over a way out after the Supreme Court banned it.  He claimed that Centre is mulling the idea of amending the law to nullify Supreme Court order on Jallikattu.  “We are getting suggestions (to amend the law). After all, we did it in the Shah Bano case,” said Naidu adding[2], “But, we will have to see. We will have to discuss. We will have to weigh what court thinks.” However, Naidu was non-committal about bringing an ordinance to deal with the Supreme Court order on Jallikattu, saying[3], “I am not dealing with the subject in the government.” Speaking at the India Today Conclave South in Chennai, Venkaiah Naidu said[4], “Personally, I feel that Jallikattu is a traditional art. It is a traditional sport in Tamil Nadu. Nobody should have problem with this.” But, Naidu also added, “I don’t know whether I should be saying this as a minister.” So just like Rajiv Gandhi, the BJP has also decided to politicize the issue, by bending the law by creating another bad precedence of law. In fact, the so-called “India Today” conclave had given much focus to the “Jallikkattu” issue, calling opinion from others. Now, let us note, what the “Shah Bano” case brought out in Indian judicial, political and religious arena.

shah-banu-venkaiya-naidu-jallikattu-act-amendment-modiThe brief of Sha Bano case[5]: Though, the details of the “Shah Bano case” are known, they are briefed here as follows[6]:

  • Shah Bano, who was 62 years old in 1978, was divorced by her husband using the triple talaq law.
  • Bano, who was left with five children, approached the court to seek justice.
  • The Madhya Pradesh High Court had instructed Bano’s husband Mohammed Ahmed Khan to provide Rs 179 per month as maintenance.
  • The case reached Supreme Court, with the bench announcing a verdict in 1985, instructing that Shah Bano should be provided all the benefits which divorced women from other religious communities are entitled to.
  • The observations of court drew sharp reaction from conservative Muslims, who called it a violation of their religious affairs.
  • Fearing ire from the Muslim community, Congress government at Centre led by Rajiv Gandhi amended the Muslim Women (Protection of Rights on Divorce) Act, 1986. The amended legislation nullified the Supreme Court’s order.

At that time, a lot of criticism was made against Rajiv Gandhi and Congress for yielding to the Islamic fundamental forces by reversing the Supre Court judgment.

jaggi-ravishankar-modi-jallikattuJallikkatu issue goes in the Sha Bano route: The political solution to this public demand in case of Jallikattu is to pass an ordinance, overturning and reversing the Supreme Court ban, is well understood, but, bad in the law. The job of the apex court is to simply interpret statutes and constitution provisions. The Apex Court enters the arena of traditions, religious practices or even cricket administration, only when such issues come to the court. In the Shah Bano case, the apex court’s verdict was overturned by Parliament (which had the brute majority of the ruling party). The utopia that the voice of “the people” is supreme too works with the ruling politicians. Unfortunately, there is a thin dividing line between robust democracy and mobocracy, or mere capitulation by politicians to mass hysteria and this is what happened in the Jallikkttu case. Who has whipped up mass hysteria to generate short-term political advantage, is yet to be known clearly, though, the sudden surge has been claimed as “spontaneous and apolitical”. It is, therefore, worth recalling incidents when the brute power of elected governments was thwarted by sound legal principles, and even the power of ordinance was blunted by the apex court. Whether the “emotional blackmail”, “ideological extortion”, “cultural counter threat”, definitely, it has shown a bad way for such incited, provoked and encouraged groups again bargain, so that the judiciary becomes a mockery of democracy.

anti-modi-demo-2017-vaikoPoliticians are interested in safeguarding their interests[7]: Of course, the most celebrated case is the Keshavanand Bharti case, fought so successfully by Nani Palkhiwala, which has ever since protected the basic structure of the Constitution of India. It cannot be amended by the legislature. A more recent example is from May 2002, when the Supreme Court decreed that all candidates who stand for elections must declare, via sworn affidavits, their criminal antecedents (if any), their wealth (ill begotten or not), and their education status. This was based on the voters’ right to know before they cast their vote. The Union Cabinet in its wisdom sought to nullify this verdict through a hastily drawn up ordinance in June 2002, as the entire political establishment did not want to disclose any information, or details of their candidates. But citizen activists across the nation got together and asked the then President Abdul Kalam to refuse to sign that ordinance. He had to sign since the Cabinet refused to budge, or dilute its ordinance. Hence, this ordinance (even before it could be presented to Parliament) was challenged in the Supreme Court as being un-constitutional. Denying information to voters was akin to denying freedom of expression (as casting a vote is like expressing yourself). Remember the Right to Information was passed in 2005, three years later. In March 2003, the Supreme Court ruled that the said ordinance seeking to gag information about candidates was unconstitutional and hence null and void. Hence the ordinance was defeated. As for Jallikattu, it’s a wholly different animal and the polticians may bend the law again[8].

jallikattu-cruelty-involvedRequesting Supreme Court to delay the judgment and passing the Ordinance (20-01-2017)[9]: Hours after the Central government requested the Supreme Court to delay its judgment on the legality of Jallikattu, citing “huge unrest” in Tamil Nadu, it approved a draft Ordinance by the state government to make an exception for bulls in the Prevention of Cruelty to Animals Act. Earlier, Attorney General Mukul Rohatgi told a bench led by Justice Dipak Misra that there were “immense problems” in Tamil Nadu due to the interim ban on Jallikattu and that the circumstances warranted delaying the judgment at least by a week. “If this court pronounces the judgment in one way or another, it (judgment) would inflame passions…there is already social unrest in the state. The Centre and the state are in talks to find a way out in the matter and our request is that the court should not deliver the judgment and hold back for a while,” submitted the AG. At this, Justice Misra asked Rohatgi how many days he wanted the judgment to be delayed. “At least for a week,” replied AG. To this, the judge responded[10]: “Okay.”
