Iron and steel – evasion prone commodities: As for as Iron and Steel manufacture and the products thereof, there has been evasion since early 1940s. Even during the 2000, when, they were brought under Componded levy scheme as “evasion prone commodities,” manufacturers and traders could collude with each other and evaded thousands of crores of duty. About“deferred payment,” initially, no time limit was mentioned and thus, many manufactured, cleared without payment of duty under the guise of “deferred payment,” and disappeared! Ironically, at that time, there were loopholes created by the higher officers at the Board level, they could evade technically with the Rules created for the furnace and rolling mills. The builders also colluded with them, as they received goods, used up in the buildings and the cash paid converted into other transactions.  Scrap imports, high sea sales, substitution with local scrap, fake invoices, dealer invoices and such other modus operandi were used where the departments and allied organizations could do little,as most of the evaders escaped with the lack of evidences and loopholes in the Act and Rules.

MNCs, money flow and corruption: As the MNCshave concentrated in and around Bangalore and they have not been worried aboutfinances, skyscrapers, five-star hotels and infrastructure have been developedquickly from 2005 and they have been changed considerably. Thus, the governmentofficials, builders, contractors, building material manufacturers-suppliers,and all other connected persons and agencies played a crucial role in theinfrastructure developments, but also in all sorts of tax evasions. As the MNCsalways claim that they do not give bribes or commissions in any form to anyofficial or facilitator, the connected persons adapted and adopted variousmethods to pump the money, reaching them, so that the work has been going onsmoothly.

Cheap labour coming from North-Eastern India, etc: Bangalore,Hosur, Mysore and other places have been hubs for the MNCs involved in IT industries, electronics, automobiles, chemicals and pharmaceuticals etc., themobility of men and materials have been considerable and huge profits earned. Cheap labour has been / is being brought from north-Eastern India and from Bangladesh. The illegal infiltrators and the so-called migrants, even coming from Myanmar pose great challenge to locals in many aspects. They create new identities, voter cards, Adhar cards, PAN cards etc. Thus, the connected other businesses – Hotels, resorts, pubs etc., also thrived. As goods and services of all sorts are required, where, money is not an issue, every thing has been going on smoothly, as all have been taken care of. However, unfortunately,certain anti-national, terrorist and economic offences criminals joined and spoiled the commercial activities.

34 fake GST registrations – proves the inefficient programming: A scam involving fake GST bills worth Rs 1,200crore has come to light in Bengaluru[1]. The preventive wing of the south commissionerate of the GST busted the racket after two month long investigations[2].The fraudulent companies were engaged in trading of fake tax invoices for availing input tax credit[3]. This has been there, even before the introduction of GST. The accused were engaged in trading of iron and steel scrap through various companies[4].The kingpins of the scam have been identified as Suhail, Basha and Hafeezur. Significantly, in this industry, most of them  have been belonging to one particular group. Suhailand Basha floated 20 fake companies and registered them under the GST by giving fake names and addresses. While Basha had obtained 14 GST registrations in the names of his relatives and others, Suhail had obtained six[5]. They floated fake companies by giving made-up addresses, which made the investigation difficult[6]. Much relaxed provisions of the GST Act and rules, resulted in such manipulations. However, it has to be noted that each must have had 20 plus 14 fake PAN and Aadhar cards also. That implies either they [PAN and Aadhar] and the figuring persons in the cards have been either fake, fictitious or dead. Therefore, the government documents, in this regard have not been fool-proof and the criminals can exploit.

One computer producing fake GST invoices for thefake companies: All companies, however, in reality operated out of a single office and the bill were generated from a single computer[7]. This has been going on even in the case of Service tax, where just to enjoy the Rs20 lakhs limit, they used to float dozens of companies. The modus operandi involved floating fake companies, issuing fake GST invoices and generating e-way bills with fake vehicle registration details without actually supplying goods[8].The companies were created with an intent to fraudulently pass on input tax credit through these fake invoices. “A search was conducted on 12th of November, 2019. We recovered some incriminating documents from 25 locations and have nabbed three persons who we believe to be the key persons involved in generating these fake invoices,” said G Narayanswamy, IRS Commissioner of Central Tax, Bengaluru South. The accused have reportedly generated and issued tax invoices having turnover of about Rs 1,200 crore having a GST liability of Rs 200 crore. Their confessions have revealed that at least 18 iron and steel producers have availed these bills to claim input credit. Further investigations are underway. 

Proceedings initiated: Meanwhile the three accused have been produced in front of the Economic Offenses Magistrate, Koramangala, arrested under the provisions of the GST law and have been remanded under 14-day judicial custody[9].The GST officials have, till now, detected an evasion of Rs 200 crore of GST in the city, and recovered Rs 140 crore so far[10].The team of GST officials included Tej Kumar, deputy commissioner, Akshatha Shrinivas, assistant commissioner and led by G Narayanaswamy, commissioner, Bangalore South detected the fraud. Incidentally, when the officers work hard and book cases like this, when the cases go to court, most of the revenue cases are lost due to many inherent reasons. Non-cooperation of the evaders in furnishing documents, request interference of vested interests, collusion of some officers, consultants and others, delaying adjudication processes at different levels, improper presentation or lack of evidences and so on. Thus, in spite of the works of honest officers, cases are lost. Therefore, the involved should have some ethics, conscience and patriotism, so that the Indian society could be saved.

5 renowned persons filed petition to release U-naxals

The emeritus, elite and enthralling status of the petitioners: The five petitioners who moved the Supreme Court on 29-08-2018, Wednesday against the arrest of the five activists were described by the prosecution as “strangers” who could not seek bail for “someone else”. The five petitioners may be “strangers” to the BJP government but not to the nation[1]:

  1. one is among the foremost historians in India – Romila Thapar[2],
  2. another is an economist honoured with the Padma Bhushan – Devaki Jain[3],
  3. the third a professor emerita and Oxford scholar – Praphat Patnaik[4],
  4. the fourth a sociology professor – Satish Deshpande[5] and
  5. the fifth a renowned civil liberties crusader who happens to be the daughter of the late Field Marshal, Sam Manekshaw – Maja Daruwala[6].

None of them has ever been linked to the Maoist insurgency, before or during the era of “Urban Naxals” or “Half-Maoists”. Below is an introduction to those who consider Romila Thapar, Devaki Jain, Prabhat Patnaik, Satish Deshpande and Maja Daruwala as “strangers”.

Dissent safety valve of democracy – Supreme Court: Earlier on 29-08-2018, Wednesday, the Supreme Court issued notices to the Centre and the Maharashtra government and directed the Pune police to keep the five accused under “house arrest” till the next date of hearing on September 6, 2018. The directions of a division bench comprising Chief Justice Dipak Misra and Justice DY Chandrachud came in a public interest litigation filed by eminent historian Romila Thapar and four others challenging the arrests before the apex court. The Court said that dissent is the safety valve of democracy[7]. Hearing over the arrests were also held in the Delhi High Court and a sessions court in Pune. The Delhi HC, which had on Tuesday stayed the transit remand of activist Gautam Navlakha, has said that it would examine the legality of the Maharashtra police action[8]. The court also slammed police for failing to produce the translated version of the FIR and said it was yet to hear the grounds of arrest. Varavara Rao, Arun Fereira and Vernon Gonsalves, on the other hand, were produced by Pune police at the sessions court there.

Media picks holes in the Police proceednigs: The document – a remand report – gave 16 reasons why the rights activists should be in police custody, but had none of the dramatic claims made by the public prosecutor in court, NDTV has learnt[9]. The police document, accessed exclusively by NDTV, claimed all activists are members of the Communist Party of India (Maoist) and set up city units of the outlawed group. However, the petition made no reference to key charges made verbally in court and communicated to the media such as a plot to assassinate Prime Minister Narendra Modi or facilitating Maoist funding and weapons via Nepal[10]. When it is communicated to the media, what is the claim of “The police document, accessed exclusively by NDTV” to blame police! The document also did not mention the clashes in January between Dalits and upper caste Maratha organisations at Bhima-Koregaon near Pune, which they were linked to.  So, it is intriguing to note why NDTV wants to dictate the police to conduct their proceedings.

If the plot-letters Two are fake, why, how and who created?: letters recovered by the police reveal the plot to kill Modi and other details to procure arms etc.[11], and therefore, if the Maoist defenders accuse / allege that they are “fake letters”, they should explain why their comrades have been keeping such “fake letters.” Moreover, the second one has been an “e-mail letter,” and print out taken giving more details[12]. Then, why such fake data are kept in their computer – a question that has to be answered. Creating fake documents, of this nature is also a crime, particularly, of this nature, implications and the issue involved. The previous proceedings clearly prove that they have been advocating violence as a means to achieve their “revolution.” Therefore, only, courts can decide the issue and not the media, demonstration or any influential talks etc.

“Dear comrade Prakash,

We received your last letter (20/3). Regarding the current situation here Arun, Vernon and others are equally concerned about the two line struggle that is slowly taking shape on the urban front. Followed by the very unfortunate demise of Bijoy da. He was a strong leader with great vision and selfless devotion to the party and the Red Revolution! His leadership was greatly needed in today’s critical times. Things were far better before Prashant’s egoist agenda took over the larger interest of the party and the political prisoners. Com. Saibaba had raised this issue with you back in 2013 when Prashant revolted against Saibaba. We think that in one way the Gadchiroli court’s judgment has helped by restraining Prashant in doing further harm to the Party. With that said, we are working tirelessly to put up a strong defense for Saibaba. Every possible legal help in favour of the jailed comrades is being sought. HB has been given all the responsibility to coordinate programmes and protests to raise public opinion in our favour. On 20th April we will organise another program under the banner – Committee for the Defense and Release of GN Saibaba. We will leave no stones unturned in providing relief to all pol. prisoners. Com. He has been studying the party literature, resolutions and the party constitution for the past several years. Despite challenging situations he is ready for second APT cross-over. This time I would like to send another comrade with Siraj. His CV is in the memory chip with this letter. Sometime in last year Vishnu had met Com. Basanta to facilitate the deal. At the time Com. Kishan was unable to meet directly. I hope by now you have received details of the meeting and requirement of 8cr for annual supply of M4’s with 400000 rounds. Please convey your decision. Defeating Hindu fascism has been our core agenda and a major concern for the party.

Several leaders from the secret cells as well as open organisations have raised this issue very strongly. We are working to consolidate ties with like-minded organsiations, pol. Parties, representatives of minorities across the country. Modi led Hindu fascist regime is bulldozing it’s way into the lives of indigenous adivasis. In spite of big defeats like Bihar and West Bengal, Modi has successfully established BJP govt in more than 15 states. If this phase continues then it would mean immense trouble for the party on all fronts. Greater suppression of dissent and more brutal form of Mission 2016 (OGH). Com. Kisanand few other senior comrades have proposed concrete steps to end Modi-raj. We are thinking along the lines of another Rajiv Gandhi type incident. It sounds suicidal and there is a good chance that we might fail but we feel that the party PB/CC must deliberate over our proposal. Targeting his road shows could be one effective strategy. We collectively believe that survival of the party is supreme to all sacrifices. Rest in the next letter.

Dubious History of Urban naxals

Why Hindutwa professors, right wing experts lack in matching Romila Thapar and other comrades?: Romila Thapar and company have come out openly and filed petition in the Supreme Court. However, no Hindutva historian, emeritus expert,  professor or anybody come forward to file a petition to support their ideology or implead then to be a party, as their counterparts have filed petition. In fact, there have been many such beneficiaries under ND regime who have been enjoying or enjoyed awards, rewards, foreign travels, postings as member of ICHR, ICCSR etc. But, none of them responded, but, keeping quite. Why cannot they match Romil Thapar or other emeritus experts? In what way, are they lacking and lagging behind their ideology or expertise? Some have gleefully have written books, “Why I support Modi?,” whereas, there, they have been plotting to kill Modi, as the media reports point out. So why this indifference, callousness or cowardice? When the ideological war has been declared and going on openly, what is the use of hiding behind and keeping silence.

[2] Romila Thapar: A professor emerita of history at JNU, the 86-year-old Thapar helped found the varsity’s Centre for Historical Studies. A scholar of ancient history, her most famous works are Asoka and the Decline of the Mauryas (1961) and Early India: From the Origins to AD 1300, for which she won the US Library of Congress’s Kluge Prize in 2008. Thapar is a pioneer in ancient historical research, who gave new insights into ancient India by studying primary sources like archaeology and who revealed that Aryans were a linguistic group, not a race. She studied in Panjab University and London’s School of Oriental and Asian Studies. After the demolition of the Babri Masjid, she went beyond the confines of academic writing to speak out against the communal interpretation of history. Thapar opposed changes to school history textbooks – one of which she had authored -when Atal Bihari Vajpayee was in power. She then faced several threats and harassment. A petition against her was filed with the Kluge Chair in Countries and Cultures of the South at the Library of Congress in 2003, alleging that she was “Marxist and anti-Hindu”. She declined the Padma Bhushan twice, on principle that she only accepted honours from academic bodies for her work.

[3] Devaki Jain: A Padma Bhushan awardee, Jain led in the field of feminist economics.The daughter of the diwan of the erstwhile Mysore princely state M. A. Sreenivasan, Jain read in Oxford. She founded the Indian Social Studies Trust in Delhi and was the Chair of the Advisory Committee on Gender for the United Nations Centre in Asia-Pacific and a member of the advisory panel of the United Nations Development Programme (UNDP) for the 1997 Human Development Report on Poverty and for the 2002 Report on Governance.She was also a member of the Eminent Persons Group of the Graça Machel Study Group appointed by the UN to assess the Impact of Armed Conflict on Children.She was married to the late Gandhian, freedom fighter, planner and former high commissioner to South Africa, L.C. Jain. Television journalist Sreenivasan Jain and Supreme Court advocate Gopal Jain are their sons.

[4] Prabhat Patnaik: A professor emeritus of JNU who helped set up its Centre for Economic Studies and Planning, Patnaik studied at St. Stephen’s College, Delhi, and went to Oxford on a Rhodes scholarship in 1966. He taught at Cambridge. He was the chairman of the Kerala State Planning Board from 2006 to 2011 and was part of a four-member task force of the UN to recommend reform measures for the global financial system in 2008. [5] Satish Deshpande: The youngest petitioner, 60-year-old Deshpande is a sociology professor in Delhi University known for his work on caste. His empirical research on Dalits have highlighted their absence in academia and the socially inferior position of Dalit converts among Christians and Muslims. He studied in JNU and later in the University of California. He has been on committees for publishing school textbooks.

[6] Maja Daruwala: The daughter of the late Field Marshal, Sam Maneckshaw, she headed the Commonwealth Human Rights Initiative for 20 years, where she focused on prison and police reforms.A lawyer by training, Maja has worked in India, England, Singapore and Sri Lanka. She sits on several charitable boards, including the International Women’s Health Coalition, NAMATI, International Record Management Trust and Public Affairs Centre, Bangalore. She is a recipient of the Nani Palkiwala Award for protection and preservation of civil liberties in India.

Bhima-Koregoan violence and the consequent arrests [December 2017 to June 2018]: The June 2018 incidences, arrests with the Bhima-Koregoan violence have been discussed earlier in June 2018 in the blogs- in two parts, pointing out the role of Congress in it[1].  Everyone knows that the Bhima-Koregoan incidences resulted in violence, spreading to Mumbai incurring loss of life and properties[2]. The anti-Modi lobbyists attended the functions and spoke without mincing words[3]. Incidentally, last July 2017, in the International Ambedkar Conference held in Bangalore, some of them had attended. When they discussed, they delved upon the issue of ousting BJP out of power[4]. Of course, one of them tried to oppose Congress also, for name sake. Consequent to the filing of FIR , police searchers, recovery of incriminating documents, “urban naxals” arrested were – Rona Wilson, Sudhir Dhawle, Surendra Gadling, Soma Sen and Mahesh Raut. As they have been elite, sophisticated and experts in their ideology, propaganda and perverted intelligence, they have been trying to divide people under the guise of right to think, express, speak, write and so on. In the name of “human rights,” they comfortably forget  the rights of the affected.

Plot to kill Modi? [Letter dated 18-04-2017 recovered from Rona Wilson laptop]: The nation wide raids conducted at the homes of prominent activists who allegedly have naxalite links is probably one of the biggest exercises. The raids were conducted at Delhi, Hyderabad, Ranchi, Goa and Mumbai were conducted after the police went through 25,000 GB of data seized from five arrested persons[5]. The police while going through the data stumbled upon the names of several persons, whose homes were raided on 28-06-2018. It was found that these persons living in the cities were either directly or closely associated with the naxalites. Very strong links have emerged, said an official part of the exercise to OneIndia. The data that was analysed in connection with the Elgaar Parishad case revealed that these persons were closely associated with the banned CPI (Maoist)[6]. They were allegedly involved in conspiring and taking part in movements with an intention of creating violence, officials also said. It may be recalled that it was during the same investigation that the police had also found that some persons were conspiring to assassinate Prime Minister Narendra Modi. The police also raided the residences of left wing activists, Varavara Rao in Hyderabad, Vernon Gonsalves who was arrested under Unlawful Activities (Prevention) Act in 2007, activist Arun Ferreira in Mumbai, trade union activist Sudha Bharadwaj and human rights activist Gautam Navalakha in Delhi. The house of Stan Swamy in Ranchi, Anand Teltumbede in Goa was also searched. Anand Teltumbede attended the Congress conference held at Bangalore in July 2017.

Arrested Maoists - Sudhir Dhawale, Shoma Sen

Earlier arrested – Sudhur Dhawle, Rona Wilson, Surendra Gadling etc in June 2018: On June 6, 2018, the police had arrested Sudhir Dhawale, leader of Mumbai-based Republican Panthers Jati Antachi Chalwal, Delhi-based activist Rona Wilson of Committee of Release of Political Prisoners, Nagpur lawyer Surendra Gadling of Indian Association of People’s Lawyers, Nagpur University professor Shoma Sen, and Mahesh Raut. The name of Rao had come up when the Pune police arrested, Surendra Gadling from Nagpur in June in connection with the Elgaar Parishad case. A letter was recovered from Gadling, in which Rao had complimented him for the success of the attack launched by naxalites in Gadchiroli. There were also letters discussing the assassination of Modi which were recovered from Rona Wilson, also an accused in the case. In addition to this the police also raided Fereira’s house in Thane. The police say that he is an alleged sympathiser of naxalites and had been arrested in the past as well. He was however discharged in all the cases.

The Police appraised the position: The moment Uraban naxals were arrested, as expected, their supporters from all intelligent groups stated opposing. Their propaganda has been so offensive, the Pune Deputy Commissioner of Police Shirish Sardeshpande had to arrange a press meet and clarify the position. During the press meet held in the city’s Shanivarwada area, said that the preparations including mobilization of funds and inciting the masses, were on since long before the Elgar Parishad was involved[7]. Elaborating, he pointed out that the alleged plot came to light after the police analysed the electronic devices, documents and other “highly incriminating evidence” seized from the five arrested persons, showing their links with the banned Communist Party of India (Maoist)[8]. This is the first official reaction from the Pune police justifying Tuesday’s arrests of –

  1. Sudha Bharadwaj, lawyer-activist,
  2. Gautam Navlakha, civil liberties activists,
  3. Vernon Gonsalves,
  4. Arun Ferreira and
  5. Varavara Rao

from different parts of India, triggering a massive outcry. However, it is ridiculous to think that the police could arrest the “experts” just like that.

Should police reveal all evidences to the media?: The Police commissioner told, “We have scanned computer hard disks, pen drives, memory cards, resolutions of meetings, documents, emails and other elaborate communications between the members of the banned CPI (Maoist) and the five arrested accused,” he said. The CPI (Maoist) had formed the “All India United Front (AIUF)” as per a resolution passed by its Eastern Regional Bureau (ERB) — an underground unit — and had hatched the conspiracy to topple the legally elected government. They analyzed 25,000 GB data to get the details. Efforts were underway to launch a similar front (AIUF) through the Elgar Parishad and included plans to collect funds, assign responsibilities, and acquire arms for the larger conspiracy. Howeve, he cannot reveal all the relied upon documents to the media, as the media people have been aiding and abetting the terrorists by sharing all information. In fact, had the arrested been really, involved, they could easily destroy such evidences incriminating. In fact, already, they started asserting that the “relied upon documents” are fake.

Naxals involved in killing innocent people: Besides, the evidence also reveals plans of the “urban Naxals” to influence and radicalize the youth and students, arms training and other details, he said. He revealed that the Maoists have been involved in many unlawful activities leading to the killings of a large number of security forces and civilians, besides links with other like-minded organisations, which were not named. In Tuesday’s [28-08-2018] operation, he said, a total of nine places were raided and the said five activists were arrested. The intellectuals should respond to their methodology of exploiting violence, killing and sabotaging to solve their problems.

5 renowned persons filed petition to release U-naxals

Five eminent experts, but unconnected filed petition to release the arrested: Among those who have moved court include Romila Thapar, Prabhat Patnaik, Satish Deshpande, Maya Darnall[9]. How these came together has been surprising and intriguing. In the petition, which was mentioned by senior advocate Abhishek Manu Singhvi, the historian and other right activists have sought release of all activists who have been arrested during raids in connection with the Bhima-Koregaon case[10].  They have also sought an independent probe into the arrests[11]. The petitioners have also urged the apex court to seek explanation from Maharashtra for ‘sweeping round of arrest’ in the case. The raids were carried out as part of a probe into the violence between Dalits and the upper caste Peshwas at Koregaon-Bhima village near Pune after an event called Elgar Parishad, or conclave, on December 31 last year, 2017[12]. However, these were keeping quite for the 31-12-2017 violence and June 2018 arrest of their collegues. Now, it is not known what compelled them to come together and file a petition in Supeme Court.

Pressure brought on the media to silence: Indian Currents, a 21-year-old publication by Catholic Church has withdrawn its cover story ‘Cardinal Sin’ “under obedience” by its chief editor Dr Suresh Mathew[1]. They had probed the land dealings by their internal team against Cardinal Mar Alencherry, the major archbishop of Syro-Malabar church. Indian Currents is a weekly news magazine published from New Delhi under the patronage of the Capuchins of Krist Jyoti Province of North India which gives in-depth analysis of day-to-day events in the socio-political and religious fields. Usually, Dr Mathew uploads the online version as early as Saturday morning when the hard copy hits the newsstand on Monday. Just when the matter was going to press this Saturday morning, he got a call from his provincial house to withdraw the cover story, an editorial by himself and the corresponding article written by Fr Jose Vallikkattu, a missionary priest belonging to the Missionary Society of St Thomas (MST). However, in this case, he had to face the Church differently.

The article published was withdrawn: “As a priest, I should be obedient. When I received a call and an email from the Provincial House asking me to wait until the internal probe is over, there is nothing I can do but withdraw at the last moment. So I have been forced to withdraw all the articles on Cardinal Alencherry’s land deals that have landed the Archdiocese of Ernakulam – Angamaly in a mess,” he told DC[2]. So Catholic priests have to cover up the crimes, sex and financial scandals and all in the name of god and save honour. But now he and his editorial team have been forced to come up with Bhima – Koregaon violence in Maharashtra where he has asked political activist John Dayal and senior journalist A. J. Philip to come up with articles on a war footing. His hard-hitting editorial states that “there is more to the episode than meets the eye”.  He recalls the words of Cardinal George Pell, Vatican’s prefect of the secretariat for the economy, who had opined a few years ago that the “next wave of the attacks of the Church could be for financial irregularities” which has since been proved right, though the expert committee’s probe is on. The detailed cover story states that “with the latest land row, however, the church has run itself the risk of losing the trust of its congregations. In fact, a church that was built on the solid foundation of unity is today divided in opinion”.

The issue of black money also comes up[3]: A church panel probing land transactions in the archdiocese of Ernakulam has recommended action against Cardinal George Alencherry under Church and civil law for causing losses to the diocese. This is the first such recommendation — the case also involves black money — for a Catholic Church in India. Alencherry is among the Indian cardinals eligible to elect the Pope. The church panel report has been sent to Rome. Ernakulam archdiocese spokesman Father Paul Karedan admitted the probe report contained grave charges against Alencherry and said the report would have reached the Pope by now. “We have sent the report to Rome via the Apostolic Nuncio (Vatican representative) in Delhi,” Karedan said. Two others were also blamed for the land deal. Last month, January 2018, the archdiocese had appointed a six-member panel, comprising priests and laymen, to probe losses suffered by the archdiocese in dubious land deals since April, 2015. Alencherry’s secretary and church spokesman Father Jimmy Poochakkattu said the Cardinal would not react now. “He will bring out a circular in which he is expected to explain everything. It will be read out in churches under the archdiocese,” he said.

The Church Report confirms financial scam[4]: The losses were incurred after the sale of five plots owned by the diocese in various parts of Ernakulam district. The diocese should have received at least Rs 27 crore from the sales, which they needed to repay bank loans, but received only Rs 9 crore after the dubious real estate deals. The report stated, “There is grave violation of the Church laws, which amounted to naked act of breach of trust and criminal misappropriation of properties.’’ The probe committee also found unaccounted money, which it termed a “grave issue”. “Total amount receivable according to 36 deeds is Rs 13.52 crore. But, there is a difference of Rs 13.62 crore between the documented amount and the amount in the curia (a diocese body) resolution. Receiving unaccounted money is a serious offence as per the Income Tax Act.’’ The church panel report stated: “The Major Archbishop (Alencherry) was directly involved in alienating all the five plots, which were sold after being divided into 36 pieces. The first deed was registered even before it was discussed in the Consulters’ Forum. Decision of the finance council quoted in all the 36 sale deeds is incorrect. The receivable value set by the diocese was Rs 27.15 crore, whereas the value according to the registered deeds was only Rs 13,51,44,260.” The report also noted that the diocese only received Rs 9.13 crore from the “agent”. “It is painful to note that at the time of execution of the sale deeds, Alencherry has not assured the receipt of money to the archdiocese.’’

Violation of Church law and civil laws along with the lack of transparency and collegiality: According to the report there were “numerous instances” of violation of Church law and civil laws along with the lack of transparency and collegiality. “As the head of the Syro-Malabar Church, Alencherry should have taken utmost care in respecting the provisions of Church laws,” the report said. Two others from the Church – priest Sebastian Vadakumpadan and the finance officer Joshy Puthuva – were also blamed for the dubious land deal. The report also named Saju Varghese Kunnel as the kingpin in the deal and alleged that he enjoyed the confidence of the Cardinal and father Puthuva. Without naming the Cardinal, the committee recommended, “People who are responsible for the crisis should be tried according the law of the Church and necessary action should be taken for the violation of the civil law.’’

Where the money has gone?: The report stated that the registration of land deeds took place in violation of all norms even without receiving the entire amount from the sale. The committee found that the value of the land was Rs 4.47 lakh per cent but the archdiocese fixed this at Rs 9.5 lakh per cent. One cent is equal to 435.5 square feet. The report has blamed Alencherry for involving Kunnel in the transaction, but the former claimed he who introduced Kunnel to the finance officer Puthuva, who in turn said he acted under Alencherry’s instructions. The committee also evaluated that the diocese has lost Rs 46 crore in various land purchase and sale deals since April, 2015. Though the price fixed for five plots was Rs 9.5 lakh per cent, the then prevailing market rate was Rs 15 lakh per cent. Secretary of priests’ council Father Kuriakose Mundadan said the council had discussed the committee report on land dealings. “Alencherry informed the priests that the council would have an elaborative debate on the report later. The meeting of the pastoral council, a body of priests and laymen, would be held after the detailed discussion on the report in the priests’ council,’’ he said. Karedan ruled out chances of Alencherry’s resignation. “He has told the priests that he would give explanation for all the allegations after studying the report. He has reservations about some of the findings in the report. He has sought some more time to explain his stand,” he said.

All Indians, who violate the Acts and Rules should be brought to book and get punished: Indians can be kept quite as this is related to Church and so on, but, the violation of law of this land is different from their internal hushing and covering ups. Just like “Katta-panchayat”, they have been concealing many crimes. Abhaya murder case is almost forgotten. Therefore, these violations cannot be simply treated as were “numerous instances” of violation of Church law and civil laws along with the lack of transparency and collegiality. Just because, they have power, money and above all, all suppressing and oppressive capabilities, even God may not forgive their sins. Even in this case, as they have crossed all the limits, their own believers have taken action to punish the guilty and bring under the law of this land.

The second session: The second panel saw Thirunavakarasu, Deputy Commissioner of Police, Intelligence speaking on how the police use social media to help keep people safe. He also mentioned how the fig leaf of anonymity is not as true as people believe, and that the police can track abusers and anti-social elements in social media within no time at all. Other speakers spoke about how ministers such as Mrs. Sushma Swaraj use social media for responding to crises and suggested that ministers and bureaucrats in Tamil Nadu could adopt such best practices. Panelists on Citizen Participation in Governance and Role of Social Media were :

The third and last session: The last panel on enhancing the quality of public discourse in social media in Tamil Nadu articulated the futility of trying to control social media, as the users come from very diverse backgrounds. Some well-thought-through advice also came through in this session. The first was to ignore provocative trolling, as any such response only begets further trolling. One should seek timely police intervention when the line of privacy is crossed and social media abuse spills over to real life. The panelists urged users not to trust everything they see on social media and to use social media constructively as a fact-checking medium. Panelists on Enhancing Quality of Public Discourse in Social Media were :

Supreme Court Judge says that her daughters are liabilities

Twisting facts: One of the defects is that the media often twist facts. I would like to give an example. One day, a leading English newspaper published on its front page a photograph of Justice Gyan Sudha Misra of the Supreme Court with the caption: “Supreme Court Judge says that her daughters are liabilities.” This was a distorted and fallacious item of news, published on the front page. Supreme Court Judges have to disclose their assets and liabilities. Against the liabilities column, Justice Misra had written: “two daughters to be married.” Strictly speaking, it was not necessary to mention this because liabilities mean legal liabilities, for example, housing loan, car loan, and so on. Justice Misra’s intention was obviously to say that she would have to spend on her daughters’ future marriage. She has three daughters (no son), only one of whom has been married. Justice Misra never said, nor intended to say, that her daughters were liabilities. The news was false and defamatory, with the obvious intention of creating a sensation.

Paid news: A second defect concerns the issue of paid news that has become prominent of late. In the 2009 elections, it was a scandal. How this vicious practice could be stopped needs to be discussed. Incidentally, in compliance with an order of the Chief Information Commissioner dated September 19, 2011, we have placed the 71-page report of the Committee consisting of Paranjoy Guha Thakurta and Sreenivas Reddy on our website, http://www.presscouncil.nic.in with the disclaimer that the Press Council had rejected this report at its meeting held on April 26, 2010.

Non-issues as real issues: A third defect is that the media often portray non-issues as real issues, while the real issues are sidelined. The real issues in India are economic, that is, the terrible economic conditions in which 80 per cent of our people are living, the poverty, unemployment, lack of housing and medical care and so on. Instead of addressing these real issues, the media often try to divert the attention of people to non-issues.

  1. Such as that the wife of a film actor has become pregnant, whether she will give birth to a single child or to twins, and so on. Are these the real issues facing the nation?
  2. At a Lakme India Fashion Week event, there were 512 accredited journalists covering the event in which models were displaying cotton garments, while the men and women who grew that cotton were killing themselves at a distance of an hour’s flight from Nagpur, in the Vidharbha region. Nobody told that story, except one or two journalists, locally.
  3. No doubt, sometimes the media mention farmers’ suicides, the rise in the price of essential commodities, and so on, but such coverage is at most 5 per cent to 10 per cent of the total. The bulk of the coverage goes to showing the life of film stars, pop music, fashion parades, cricket and astrology.

Tendency to brand: Here is a fourth defect. Bomb blasts have taken place near the Delhi High Court, in Mumbai, Bangalore and so on. Within a few hours of such a bomb blast, many TV channels started showing news items that said that the Indian Mujahideen or the Jaish-e-Mohammed or the Harkatul-Jihad-e-Islam had sent e-mails or text messages claiming responsibility. The names of such alleged organisations will always be Muslim ones. Now, an e-mail can be sent by any mischievous person, but by showing this on TV channels and the next day in the newspapers, the tendency is to brand all Muslims as terrorists and bomb-throwers.

How “social media” is manipulated by politicians, business men and ideologists: The following attitude is also not discussed for solution.

  1. Ironically, that the fake news are manufactured by the media houses is accepted by the panelists and responsible activists.
  1. As usual, they only explained nicely the sins, but, have not provided any solutions to remove it.
  1. 50 to 100 and more persons are paid to sit and manipulate “social media” with fake IDs etc., working under the banner of “IT cell”!
  1. No opposite views are encouraged, accepted and hen such views are suppressed or attacked strategically or hacked as last resort.
  1. “I say, you accept” authoritarian attitude is noted. Those who opposed are blocked, hacked and silenced.
  1. The nexus of the politicians, businessmen, cine-field and ideologists is well established and thus, they control the social media.
  1. Even the schools, colleges and universities are manipulated for their business and profits.
  1. Ideologists turned agents demand ransom for their support and hence they go on attack others with one or the other issue.
  1. The media does not discuss important issues of common men, but, always mislead with manufactured data and information.
  1. After cinema, cricket, now, the “social media” has come and people are compelled to join, waste time and get spoiled.

Social media responsibility

What is the use of these conclaves for common men?: Ironically, the crimes committed because of the influence of social media, the girls and women raped through “facebook” courtship and related issues are not discussed. Again, to assess the conclave and the result, question arises, what it has achieved or going to achieve. The educated elite of these categories with safe job, position and status, they would be surviving, whether Modi is in power or not, but, there have been real workers and opportunistic “new comers”, they would be disturbed, if change occurs. While the former suffer heavily, the later would disappear finding way for their business. For ordinary people, all these verbose, ideologies, data and information and nothing is useful. They do not use social media and it cannot reduce prices, but, encourage intellectual stupidity and arrogance thriving on likes and following. The prices of essential commodities are not going to get reduced, when they go on discuss GDP and all. The number of phone users may increase with the profits of the companies. As long as phone is linked with Adhar, ration card and other things, it looks nice, but, if they do not get rice, sugar, oil and other things, they have to die. At that time all these experts cannot do anything.
