Shah Bano and Jallikkattu: How BJP has gone in the Congress way to bend the law!

shah-banu-venkaiya-naidu-jallikattu-act-amendment

Venkaiah Naidu citing “Shah Bano” case precedence (10-01-2017)[1]: Venkaiah Naidu hinted that in the view of strong emotional connect of the people of Tamil Nadu with jallikattu, the Centre was mulling over a way out after the Supreme Court banned it.  He claimed that Centre is mulling the idea of amending the law to nullify Supreme Court order on Jallikattu.  “We are getting suggestions (to amend the law). After all, we did it in the Shah Bano case,” said Naidu adding[2], “But, we will have to see. We will have to discuss. We will have to weigh what court thinks.” However, Naidu was non-committal about bringing an ordinance to deal with the Supreme Court order on Jallikattu, saying[3], “I am not dealing with the subject in the government.” Speaking at the India Today Conclave South in Chennai, Venkaiah Naidu said[4], “Personally, I feel that Jallikattu is a traditional art. It is a traditional sport in Tamil Nadu. Nobody should have problem with this.” But, Naidu also added, “I don’t know whether I should be saying this as a minister.” So just like Rajiv Gandhi, the BJP has also decided to politicize the issue, by bending the law by creating another bad precedence of law. In fact, the so-called “India Today” conclave had given much focus to the “Jallikkattu” issue, calling opinion from others. Now, let us note, what the “Shah Bano” case brought out in Indian judicial, political and religious arena.

shah-banu-venkaiya-naidu-jallikattu-act-amendment-modiThe brief of Sha Bano case[5]: Though, the details of the “Shah Bano case” are known, they are briefed here as follows[6]:

  • Shah Bano, who was 62 years old in 1978, was divorced by her husband using the triple talaq law.
  • Bano, who was left with five children, approached the court to seek justice.
  • The Madhya Pradesh High Court had instructed Bano’s husband Mohammed Ahmed Khan to provide Rs 179 per month as maintenance.
  • The case reached Supreme Court, with the bench announcing a verdict in 1985, instructing that Shah Bano should be provided all the benefits which divorced women from other religious communities are entitled to.
  • The observations of court drew sharp reaction from conservative Muslims, who called it a violation of their religious affairs.
  • Fearing ire from the Muslim community, Congress government at Centre led by Rajiv Gandhi amended the Muslim Women (Protection of Rights on Divorce) Act, 1986. The amended legislation nullified the Supreme Court’s order.

At that time, a lot of criticism was made against Rajiv Gandhi and Congress for yielding to the Islamic fundamental forces by reversing the Supre Court judgment.

jaggi-ravishankar-modi-jallikattuJallikkatu issue goes in the Sha Bano route: The political solution to this public demand in case of Jallikattu is to pass an ordinance, overturning and reversing the Supreme Court ban, is well understood, but, bad in the law. The job of the apex court is to simply interpret statutes and constitution provisions. The Apex Court enters the arena of traditions, religious practices or even cricket administration, only when such issues come to the court. In the Shah Bano case, the apex court’s verdict was overturned by Parliament (which had the brute majority of the ruling party). The utopia that the voice of “the people” is supreme too works with the ruling politicians. Unfortunately, there is a thin dividing line between robust democracy and mobocracy, or mere capitulation by politicians to mass hysteria and this is what happened in the Jallikkttu case. Who has whipped up mass hysteria to generate short-term political advantage, is yet to be known clearly, though, the sudden surge has been claimed as “spontaneous and apolitical”. It is, therefore, worth recalling incidents when the brute power of elected governments was thwarted by sound legal principles, and even the power of ordinance was blunted by the apex court. Whether the “emotional blackmail”, “ideological extortion”, “cultural counter threat”, definitely, it has shown a bad way for such incited, provoked and encouraged groups again bargain, so that the judiciary becomes a mockery of democracy.

anti-modi-demo-2017-vaikoPoliticians are interested in safeguarding their interests[7]: Of course, the most celebrated case is the Keshavanand Bharti case, fought so successfully by Nani Palkhiwala, which has ever since protected the basic structure of the Constitution of India. It cannot be amended by the legislature. A more recent example is from May 2002, when the Supreme Court decreed that all candidates who stand for elections must declare, via sworn affidavits, their criminal antecedents (if any), their wealth (ill begotten or not), and their education status. This was based on the voters’ right to know before they cast their vote. The Union Cabinet in its wisdom sought to nullify this verdict through a hastily drawn up ordinance in June 2002, as the entire political establishment did not want to disclose any information, or details of their candidates. But citizen activists across the nation got together and asked the then President Abdul Kalam to refuse to sign that ordinance. He had to sign since the Cabinet refused to budge, or dilute its ordinance. Hence, this ordinance (even before it could be presented to Parliament) was challenged in the Supreme Court as being un-constitutional. Denying information to voters was akin to denying freedom of expression (as casting a vote is like expressing yourself). Remember the Right to Information was passed in 2005, three years later. In March 2003, the Supreme Court ruled that the said ordinance seeking to gag information about candidates was unconstitutional and hence null and void. Hence the ordinance was defeated. As for Jallikattu, it’s a wholly different animal and the polticians may bend the law again[8].

jallikattu-cruelty-involvedRequesting Supreme Court to delay the judgment and passing the Ordinance (20-01-2017)[9]: Hours after the Central government requested the Supreme Court to delay its judgment on the legality of Jallikattu, citing “huge unrest” in Tamil Nadu, it approved a draft Ordinance by the state government to make an exception for bulls in the Prevention of Cruelty to Animals Act. Earlier, Attorney General Mukul Rohatgi told a bench led by Justice Dipak Misra that there were “immense problems” in Tamil Nadu due to the interim ban on Jallikattu and that the circumstances warranted delaying the judgment at least by a week. “If this court pronounces the judgment in one way or another, it (judgment) would inflame passions…there is already social unrest in the state. The Centre and the state are in talks to find a way out in the matter and our request is that the court should not deliver the judgment and hold back for a while,” submitted the AG. At this, Justice Misra asked Rohatgi how many days he wanted the judgment to be delayed. “At least for a week,” replied AG. To this, the judge responded[10]: “Okay.”

Dhulagarh communal riots: Nothing happened, after all, it was a “local issue” – now everything settled – – why Dhulagarh riots have been communalized, secularized and neutralized! (3)

dulagarh-14-12-2016-mamta-could-answer

TIMES NOW Report From Dhulagarh (December 23, 2016)[1]: For the past one week (13-12-2015 to 20-12-2016), a small town in Howrah, West Bengal has been simmering, boiling and burning. For the past seven days, the people of Dhulagarh have been facing unthinkable hardships – causing many to flee their homes. It all began on December 12, 2016 tension erupted in Dhulagarh when two groups reportedly clashed as a procession was brought out in the area last week. The groups hurled bombs at each other, when houses in Dhulagarh were attacked by an angry mob that hurled bombs and looted and torched people’s homes after they were not allowed to carry out a the procession. So the reportedly attacked groups hurled bombs on each other, however, the homes were targeted, as the processionists had no houses there! How then, the processionists plan to come there with bombs, where houses were there and the people were also there with bombs, so that they could hurl against them? Here, who took out the procession is not mentioned on the occasion of “Miladu Nabi”!

dulagarh-14-12-2016-rioters-in-action-mamta-nothing-happenedSo, Surojit Khara was bold enough to be there, when bombs were hurled and his house was burnt down: TIMES NOW spoke to one resident of a colony in Dhulagarh that was ransacked and torched.  “That day was normal, just like any other day. Some of my neighbours were running. I was thinking whether something was happening. Nobody was ready to talk about it. Then a hoard of people arrived, and started hurling bombs. They looted us and set our houses on fire,” said 28 year old Surojit Khara, who stands as the sole guard of his house – the others have fled the area. “My house, shops were set on fire. This entire lane was set on fire. The temple nearby was attacked with at least 25 bombs. This went on for 3-4 hours,” Khara stated. Frantic calls were reportedly made to the police, who turned up around three to four hours later. The police had to use tear gas to bring the situation under control, reports add. The residents however claim that no action was initiated by the cops even as the violence raged on[2].

dulagarh-14-12-2016-mamta-prays-for-muslimsFirst, it was reported that the Miladi Nabi processionist were Muslims and the targeted were Hindus: On 23rd December, the Times-Now could not tell that the processionist were Muslims. On 31st December, Daily Mail and India Today could identify that the processioners were Muslims and the people who were attacked by them were Hindus. Thus, the sufferings of the Hindus by the Muslim rioters have been brought out by Minhaz Merchant and Insrajit Kundu in “Daily Mail”[3]. Though, the State government announced holiday on 12-12-2016, on the pretext of the Miladu-Nabi procession, the Muslims carried out a rally cum procession, particularly on the auspicious day of “Margashirsha purnia” on 13-12-2015[4].  Knowingly, that particular area, Hindus was performing their celebrations, how the police allowed the procession is intriguing. Any careful or secular police officer would have prevented it, but, it was not done. When they were playing songs in high pitch, after the request of the Hindus, they could have reduced the volume, had they really wanted t respect the sentiments of their Hindu-brethren, but, they did not do. The riot started on 13-12-2016 and continued on 14-12-2016[5].  In fact, as, nowadays, it is common that Police used to videograph entire procession-proceedings, the could easily fix who started provocation leading to riot. Even, if riot started, they must have stopped it. But, what happened was different.

dulagarh-14-12-2016-rioters-in-action-3“Pakistan Zindabad” – would not have been shouted by the Hindus of Dhulagarh: The Hindus had to run to save their lives, leaving their houses and shops with all their belongings. At that time only, the rioters looted, poured petrol and kersine and burnt down. All valuables, cash and other things were carried away. Crude bombs were thrown to terrorize them and reducing their belongings to ashes[6]. The local police remained inactive while the mobs resorted to loot and arson. In one place the police arrived on the spot after the mobs had left. In another they ordered the residents to leave within two minutes and then watched on as the mobs looted and ransacked the house[7]. In yet another, the police came on time but they themselves fled when the mob came[8]. Just adjacent to the Manna household on Banerjee para lives the Mondal’s. Maitri Mondal, a mother of two says she heard chants of “Pakistan Zindabad” as the violent mob entered her bedroom and set it ablaze[9].  Thus, the souting of “Pakistan Zindabad” is intriguing to show their sickening mentality. Dilip Khanra was among many who had locked themselves up inside a room when the mob was nearing the village, pelting crude bombs one after another. “When the police came, we were told to leave our houses in two minutes! They didn’t even stop the mob from vandalizing our homes. They kept looting and burning as the police stood as silent spectators,” he says[10]. Again this proves the role of police in “running the riot”.

dulagarh-14-12-2016-zee-tvTaking strict action against Dhulagarh rioters & compensating: The Governor ordered the DGP to submit a report on the riots and that brought pressure on the government[11]. Meanwhile, top officials at the state home department said SP Howrah (Rural) Sabyasachi Raman Mishra was transferred in the wake of violence in less than a fortnight of his appointment[12]. The West Bengal government today said it had taken strict actions against those involved in the Dhulagarh riots in Howrah district and also started compensating the affected[13]. Rs 30,000/- was announced for the families who lost their houses burnt, but, they told that the compensation was meagre, as they lost everything in their house including money and day-to-day usage articles. A top official at the state secretariat said the government has already started compensating the families affected by the violence which rocked the district earlier this month. “Families in Dhulagarh which have been affected will be compensated. We have also decided to rebuild the houses damaged during the riots,” the officials said on 28-12-2016. Asked if persons involved in the riots were booked, the official said, “The state government has already taken strict action in the matter and arrests have been made… Law will take its own course.” Sources in the district police said people are wary of returning to their homes and thus have to remain homeless, barely 20 km from the state secretariat[14].

secularized-and-neutralized-as-if-nothing-happened-dhulagarh-riotsSecularization of riots, communalism and historiography – is it Marxist or Mamta way?: How Dhulagarh riots have been secularized has been explained above. How “secularism” discourse is used always against “communalism”, where, the former is linked with “Islamism” and the latter with “Hinduism”, reportedly followed by the “Sangj Parivar”. This has been the topic of the seminar held at Thiruvanathapuram by the IHC-experts and a part of IHC, as coincided, decided and attended by the elite, eminent and emeritus historians like Romila Thapar and also Marxist CM-politician Prannayi Vijayan. Last year, there was a coincidence that the Malda riots started just after the IHC session held there. But, how the Dhulagarh riots were completed, and the IHC started with “Secularism” seminar. However, much of secular discourse was carried on Mamta there the TMC-CM, just like Rolima Thapar. Now both are over and we have to wait and see as to Thiruvanathapuram, i.e, Kerala would go in the “Malda way” or “Mata way”, as Mamta appears to have donned the “Marxist garb”!

dulagarh-attacked-on-14-12-2016-rioters-in-action

Indian Express reported only on 17-12-2016, but based on Police version[1]: DHULAGARH IN Howrah continued to be tense on Friday (16-12-2016), days after an attack on a procession held to mark Prophet Muhammad’s birth anniversary (13-12-2016). Houses and shops were burnt down in a retaliatory attack. Since Tuesday (13-12-2016), when the violence started, over 25 people have been arrested. “The Muslims have claimed that they were ambushed by a group of Hindus, who had objected to the procession. The violence was controlled and we arrested a few people,” said a senior police officer. The next day (14-12-2016), a Muslim mob allegedly attacked Hindu homes and shops and them ablaze. “Policemen rushed to the spot and managed to diffuse the tension. But the next day, for almost two hours, there was a stand-off between the police and rioters from both communities. They were carrying bombs… We used tear gas shells… Finally, we had to call in reinforcements to bring the situation under control,” said the officer. Police said a case has been registered under charges of rioting and breaking communal harmony against members of both communities. “The situation is under control… Forces, including RAF, have been posted at Dhulagarh to maintain peace,” said an officer[2]. When contacted, Trinamool Congress MLA from Sankrail in Howrah, Sital Kumar Sardar, said: “There was some tension. But both communities sat down with the police and came to an amicable solution. Peace has been restored.” Incidentally, here also, the reporter is “Aniruddha Ghosal”, but, he did not express anything of that sort as reported on 29-12-2016.

dulagarh-attacked-on-14-12-2016-rioters-and-policeThe First post’s report appeared on December 28, 2016 based on the reports of other newspapers![3]: Dhulagarh, a town 25 kilometres west of Kolkata, has been simmering for the past fortnight, following communal clashes that saw people’s houses and shops being targetted and set on fire. A “Times Now report” said 65 people have been arrested, and the state administration has asked the DGP Surajit Kar Purakayastha to take prompt action against the culprits and to ensure peace. The tension erupted on 12 December, 2016 when two groups clashed as a procession was brought out in the area last week[4]. After the groups were not allowed to carry out the procession, the “Times Now website” reported, they hurled bombs at each other, and the angry mob also looted and torched people’s homes. The next day, on 13 December, 2016 the occasion of Milad-ul-Nabi, there were further clashes in the area. A section of locals claim the clashes were unprovoked, according to a report in the “DNA newspaper”[5].

dulagarh-14-12-2016-temples-attackedLocal residents claim that they had to flee with their children and elderly as soon as the mob hurled country-made bombs at their houses. Later, the mob allegedly looted the houses and fled with the money and jewellery, later also setting it on fire[6]. “Nothing is left. We are looted of all our belongings. They ransacked and vandalised our houses and eventually set them on fire. We could not save a single penny from our houses, only managed to save our children and ran for life,” said a local, Lakshmi Mallya. The violence didn’t stop there, however. The next day, a Muslim mob allegedly attacked Hindu homes and shops and them ablaze, reported “The Indian Express”. “Policemen rushed to the spot and managed to diffuse the tension. But the next day, for almost two hours, there was a stand-off between the police and rioters from both communities. They were carrying bombs. We used tear gas shells. Finally, we had to call in reinforcements to bring the situation under control,” an officer said.

dulagarh-14-12-2016-rioters-in-action-2BJP group prevented from going to Dhulagarh: A case of rioting and breaking communal harmony was registered against members of both communities. “The situation is under control. Forces, including RAF, have been posted at Dhulagarh to maintain peace,” the “Indian Express” report quoted the officer as saying. However, despite the heavy presence of police and armed forces in the area, things didn’t return to normalcy. A Bharatiya Janata Party (BJP) delegation — comprising party leaders Jagdambika Pal, Satpal Singh, state president Dilip Ghosh and national secretary Rahul Sinha, and several volunteers — was stopped at Ekabbarapur Road, about one kilometre away from the spot where the clashes had taken place a few days ago, reported “The Quint”[7]. Angered by this, the BJP delegation, along with thousand-odd supporters, blocked the road in protest. Alleging that there is no law and order in the state, Pal said the government was following “appeasement politics towards a particular community”. Ghosh alleged right-wing Muslim outfits and Simi activists have entered the area and were creating trouble[8]. He also said BJP was not given prior any information about prohibitory orders being imposed in Dhulagarh. “We are surprised that police did not allow us to approach the people in the area to know about their plight of sufferings,” Ghosh said.

dulagarh-14-12-2016-chaudhary-vs-banerjeeThe Police became “secular” with the rioters and also with the political parties: CPM the opposition party also attempted to do the same. However, perhaps in an attempt to prove that they weren’t targeting one specific political party, the police also stopped a CPM delegation from entering the violence-scarred area. The CPM team comprised party general secretary Sitaram Yechury, Lok Sabha MP Mohammad Salim and MLA Sujan Chakraborty, among others, said another report in The Indian Express. Having addressed a public rally at Dhulagarh Chaurasta (crossing) and appealed for peace, the CPM leaders tried marching to the locality where arson and clashes had occurred, but the police stopped them. “If we are not being allowed to enter even now, and there is Section 144 of CrPC imposed, it means the situation still hasn’t been brought under control,” Salim said. “Our demand is for the state government to bring normalcy immediately, and paying monetary compensation for those affected by violence.”

sudhir-chaudhary-facebook-27-12-2016Cases filed against Zee-TV reporters for covering the riots: Under fire from various quarters, the state government imposed restrictions on the media regarding coverage of the Dhulagarh violence[9]. According to The New Indian Express, the state government even went a step ahead and slapped a non-bailable offence against three employees of the TV channel Zee News, including editor Sudhir Chaudhary, West Bengal correspondent Pooja Mehta and cameraperson Tanmay Mukherjee under Section 153A (promoting enmity) of the Indian Penal Code[10]. However, the Sankrail police didn’t confirm registering an FIR. “We register over 30 FIRs on a daily basis. We can’t distinguish which are related to Dhulagarh,” said a police officer at the Sankrail police station. Chaudhary took to social networking site Facebook to call the action taken against his channel an example of the West Bengal government’s “intolerance”. “It’s another low point in our democracy to see a democratically elected govt using police force to curb media in an effort to suppress uncomfortable facts and reality. When you can’t manage media, use the state machinery to conquer the media only to conceal the failures of your administration. It shows the intolerance of a chief minister who is using the state machinery as her personal fiefdom and acting like a feudal lord,” he wrote[11]. In a case of crackdown on press freedom, a non-bailable warrant was filed against Zee News reporters by the government of West Bengal for covering the Dhulagarh riots, claims Zee News editor Sudhir Chaudhury[12]. He wrote on Twitter: “@MamataOfficial Govt files FIR against me& @ZeeNews reporter for covering #DhulagarhRiots with Non Bailable sections. FIR for showing truth?”

Why the “inter-community marital status” of Syed Mohammad Imran and Latika Dhikshit failed in Secular India?

November 14, 2016

Why the “inter-community marital status” of Syed Mohammad Imran and Latika Dhikshit failed in Secular India?

sheila-son-in-law-dyed-muhammad-imran

Hindu woman married to a Muslim man: Dikshit’s daughter Latika Dikshit Syed is known for her “inter-community marital status”, thus mentioned “the Financial Express”, adding, “But the report said, she had separated from her husband 10 months back”. So what made them to get separated or why the “inter-community marital status” did not work between them is not explained. Latika, a trained social worker and a rural development consultant, so far stayed away from active politics. So far, it was good, but for the “inter-religious marital” accord, harmony and amity. The inter-religious and inter-caste marriages in India is exalted as revolution to break communalism, casteism and other medieval evils. However, rarely, it is discussed about the success or failure of such bondages created with progressive, secular and revolutionary compulsions.

latika-syed-married-to-muhammed-imranDid the daughter Latika really want to avenge the defeat of her mother?: In 2014, there were discussions that she may make her political debut in the upcoming Assembly elections in the national capital[1]. According to leaders privy to the party’s electoral strategy for the polls, Latika Dikshit Syed wanted to jump into the fray from the New Delhi constituency “to avenge her mother’s humiliating defeat at the hands of Aam Aadmi Party (AAP) convener Arvind Kejriwal”[2]. The political pundits did not predict about her fight by joining Congress itself. Meanwhile, Sheila Dikshit has been declared Congress’ chief ministerial nominee in the upcoming Uttar Pradesh Assembley elections. Therefore, whether, the political ambitions of Latika Syed or Syed Mohammad Imran have been shattered or otherwise are not known. Whether, the politics could have been a reason for the breakage of the wonderful bond or the “inter-community marital status”created.

latika-with-dikshit-motherSyed’s potential candidature – to her family’s long-standing ties with the Gandhi family in addition to her ‘secular credentials’ given her inter-community marital status[3]: The daughter of former Delhi Chief Minister Sheila Dikshit is likely to make her political debut in the upcoming Assembly elections in the Capital. According to leaders privy to the party’s electoral strategy for the polls, Latika Dikshit Syed wants to jump into the fray from the New Delhi constituency “to avenge her mother’s humiliating defeat at the hands of Aam Aadmi Party (AAP) convener Arvind Kejriwal last December”. Ms. Dikshit, in her early 40s, is a trained social worker. Her brother Sandeep Dikshit, former Lok Sabha MP from East Delhi, is understood to have played ‘a major role’ in convincing Ms. Syed to throw her hat in the political ring even as he held himself back from doing the same, according to party sources. Meanwhile, the party’s Central leadership, insiders said, was ‘more or less convinced about’ putting its weight behind Ms. Syed for a variety of reasons ‘at the moment’. These range from her training in social work to her image as ‘an adequately experienced though young and dynamic leader’. “Her potential candidature has gone well with national vice-president Rahul Gandhi, who is in favour of younger leadership for our Delhi unit, and is convinced that she is a party worker with her ear to the ground,” said a senior party leader. Another party leader attributed Ms. Syed’s potential candidature to her family’s long-standing ties with the Gandhi family in addition to her ‘secular credentials’ given her inter-community marital status[4].

sheila-with-her-daughter-and-son-in-law-close-viewSyed Mohammad Imran arrested from Bangalore and brought to New Delhi: Former Delhi Chief Minister Sheila Dikshit’s son-in-law Syed Mohammad Imran has been arrested for allegedly subjecting his wife to domestic violence[5]. Imran was arrested from Bengaluru two days ago 11-11-2016 after Sheila Dikshit’s daughter Latika filed a case of domestic violence case against him at the Barakhamba police station. Imran was arrested from Bengaluru and brought to Delhi on transit remand, said a senior police official. The accused and Dikshit’s daughter Latika had been living separately for the last ten months since August 2016 and they have no children[6]. The arrested son-in-law of former Delhi Chief Minister Sheila Dikshit had begun torturing his wife after Dikshit lost power in Delhi during the 2013 elections.

latika-syed-with-her-mother-sheila-dikshitSyed Mohammad Imran’s behavious changed after the defeat of his Mother-in-Law:  Dikshit’s daughter Latika has alleged that her husband Syed Mohammad Imran had been living happily since their marriage in 1996 but things went awry after her mother lost the elections[7]. So what interest Syed Mohammad Imran was having in “political win” is intriguing. “Imran’s behaviour changed suddenly after my mother lost the elections in 2013. He turned aggressive and rude and subjected me to torture,” Latika reportedly said in her complaint to Delhi Police which arrested Imran on charges of domestic violence, theft and adultery[8].

sheila-with-her-daughter-latikaEyeing on the Nainital property by Syed Mohammad Imran: One of the allegedly stolen articles that the victim highlights in her complaint were papers pertaining to a land in Nainital she owns. Latika had alleged that Imran took away papers of the Nainital land owned by her, despite having been told not to do so in May 2016[9]. Latika also accused one of her female relative of being “in connivance” with Imran, they said[10]. It is simply intriguing to note that Syed wanted the property, to have affair with another woman, quarrel with Latika, and so on. Working in IT Company and having a VIP wife, can he get along by doing all nonsense? How he could live successfully with all such disturbances, without neighbours or friends knowing, that too, living in posh-Bangalore.

sheila-with-her-daughter-and-son-in-lawDeveloping relation with another woman: On the instance of Latika, police have also arrested a woman in the case with whom Imran had allegedly developed an illicit relationship. Delhi Police confirmed the arrest on 13-11-2016, Sunday[11]. The police who had been tracking him for several days traced him to Halasooru where he was staying in a rented house[12]. Deecan chronical reported[13] that “According to the police, Syed Imran was arrested from a hotel on M.G. Road on Friday”. He was working at a software firm in the city[14]. The couple had frequent tiffs over domestic issues, including the custody of their child and Imran used to make abusive calls to Latika regarding the same, the police said. A senior police official said Dikshit’s daughter accused Imran of subjecting her to violence, almost choking her to death on one occasion[15]. She alleged that the two accused have been in an illicit relationship for the past two years 2014-2016[16].

Latika Dikshit filed complaint against her Muslim husband on many accounts: Latika told police that jewellery and other valuables had been missing from her Hailey Road house and whenever she asked Imran about their location, he would only give evasive replies. Police has also charged him under several sections of the IT Act. According to an official of Barakhamba Road police station, Latika had lodged criminal complaint against Imran in June this year 2016. “We contacted Imran several times to come to Delhi for investigation. He was ignoring our calls repeatedly. Following directions from senior officers, a team was sent to Bengaluru which arrested him there,” an official said. Delhi police produced Imran in a Bengaluru trial court and secured his transit remand to pursue the case further in Delhi. Imran had been living in Bengaluru until Delhi police arrested him. Latika along with her two children was living with Sheila Dikshit in her Delhi house. Thus, it is evident that “Zeenews” has wrongly reported about the children.

Indians as fans, followers and consumers have right to research, assess and analyse celebrities: Indians need not worry about the personal lives of the politicians, cine actors, celebrities and others in general. However, as they are held as social symbol, societal trade mark and cultural brand to decide the values of Indians, Indians have to research, assess and analyse them by all means. Through the print and electronic media, they poke into Indian society, sit on many social issues and adjudicate many cases without any care for Indians. Just less than or 1% of these categories have been deciding issues ad forcing others to accept. So when they fail on many accounts, naturally, they have to come out and confess to the Indian fans, followers and consumers about their failure. In India, mostly the politicians, cine actors, celebrities propagate such secularistic programs and therefore, they too have “Social Responsibility” to answer. So let us see, how this case is continued, adjudicated and decided.

What has been happening at JNU? – Can it be liberated from controversies, ideologies and politics?

What has been happening at JNU? – Can it be liberated from controversies, ideologies and politics?

JNU-Anmol-Ratan

JNU with controversies: Jawaharlal Nehru University (JNU) started in 1969 has been embroiled, enmeshed and entangled with many controversies, because of political affiliation of the students for the last 50 years. Generally, the JNU professors, Assistant professors etc., behave, as if they have come from heavens or the others who invite them foe talks, treat them in such a way, they might be tempted to behave like that. Any way, during the last decades, definitely, they have been pampered in many ways that they themselves accustomed to be treated so. Amidst the ongoing unrest in the Jawaharlal Nehru University (JNU) over ‘anti-national’ slogans, there is a BJP MLA who had gone one step forward in defaming the varsity and its students[1]. According to BJP MLA from Ramgarh in Rajasthan’s Alwar district Gyandev Ahuja, those studying in JNU are involved in activities including ‘sex and drugs’ among others[2]. He commented in February 2016. A dossier 200-page report prepared by a group of teachers of the Jawaharlal Nehru University is likely to add more fuel to the fiery controversy surrounding the prestigious academic institution[3], which has been put together by a group of 11 JNU teachers, describes the university as a “den of organised sex racket.” The document, which was prepared in 2015 and released only recently – in April 2016 – to a few journalists, has been submitted to the JNU administration[4]. In May 2016, a student was arrested for raping his classmate[5]. Now, news has come that one JNU student raped another student!

Anmol Ratan CSDE student

CSDE research student booked for rape: A JNU student, an activist of the All India Students’ Union (AISA[6]), has been booked for allegedly drugging and raping a 28-year-old research scholar at his university hostel room on Saturday 20-08-2016[7].  Anmol Ratan is a student at the Centre for the Study of Discrimination and Exclusion (CSDE) under the prestigious School of Social Sciences (SSS), while the alleged victim is a PhD student[8]. Incidentally, the Centre for the Study of Discrimination and Exclusion has been involved in producing negative issues with selective interpretation on social issues. The sole representative of ABVP in an otherwise Left-dominated JNUSU, Saurabh Sharma, told Mail Today that he had already written to the V-C demanding stern action against the accused, including his immediate rustication from the varsity[9].

The rape victim complained to the police: According to the complaint filed by her at Vasant Kunj (North) police station, she had posted on her Facebook profile that she wanted to watch ‘Sairat’ movie and asked if anyone had a CD of it. It said Ratan apparently messaged her saying that he had a copy. Thereafter, he picked her up 20-08-2016 on the pretext of giving her a CD of the film and took her to Brahamputra Hostel, where he stays. She said in the complaint that he offered her a spiked drink and allegedly raped her[10]. He also threatened her and asked her to not report the matter[11]. However, the woman approached the police on 19-08-2016 and a case of rape was registered and further investigation is underway[12]. The police took the woman to hospital for a medical examination on Sunday 20-08-2016, after she filed the case[13]. “We have questioned several students of Brahmputra Hostel where the accused stays. We have also contacted senior officials of the university for assistance in our investigation,” said a senior police official.

The police version of what happened: Additional Deputy Commissioner of Police-I (South) Nupur Prasad said that on Sunday 21-08-2016, the purported victim approached the police with her complaint and stated that she had been raped by Anmol Ratan, a student of JNU and an activist of student organisation AISA[14]. The victim is in the first year of her Phd in one of the JNU schools. “She alleged that in the month of June, she had put a statement on Facebook that she wanted to watch a film called Sairat and had asked if anyone had a copy. She alleged that Anmol messaged her that he had a copy of the film. She further added that on Saturday, Anmol picked her from her hostel on the pretext of providing her the film and took her to his Brahamputra Hostel room where he offered some drinks to her and after that committed sexual assault with her,” said Ms. Prasad. She added that initially the accused had kept the woman confined and had not allowed her to go, even threatening her against revealing the incident to anyone. The following day she visited the Vasant Kunj (North) police station and shared her ordeal. “On the basis of statement of complainant a case under sections 376 (rape) and 506 (criminal intimidation) of the Indian Penal Code has been registered and further investigation is in progress,” said Ms. Prasad. The accused had not been arrested till late Sunday night. “We stand by the complainant and will extend all possible support in her fight for justice,” the AISA said.

sucheta AISA President

AISA expels anmol Ratan: When contacted AISA said it has taken strong note of the allegations and has expelled Ratan from the membership. “AISA takes serious note of the fact that Anmol Ratan, a leading activist of AISA, is facing a criminal complaint of sexual assault. He is, henceforth, expelled from the primary membership of AISA[15]. “AISA will reflect on and deal with this issue with all the firmness it deserves. AISA will be unflinching for the principles of gender justice even if it involves a leading member of the organisation. We stand by the complainant in her fight for justice,” Ashutosh Kumar, AISA Delhi State Secretary, said[16]. Condemning the incident as a blot on the varsity’s image, the JNU authorities urged the community in the varsity to remain vigilant against such incidents. “JNU always stands for dignity of the individual, respect for women and democratic values. The administration strongly condemns an incident of heinous rape in a campus hostel. It has completely shaken the JNU community and has tarnished the image of the university,” an official statement said[17].

Anmol Ratan -jnu-rape

AISA president’’s note: “Two days have passed since the report of sexual violence against Anmol has come. Anmol was an AISA leader. We have expelled him from primary membership and told all our units not to remain in any contact with him. He is also presently a JNU student. JNUSU has demanded immediate suspension of Anmol. But no action has been taken from the JNU administration. He has also not been arrested yet. Anmol should be given no opportunity to use his position as an erstwhile student leader in his defence. The responsible institutions must not leave any space for that. He must not only be suspended immediately but also declared out of bounds from JNU. He must also be arrested immediately. Let us all demand immediate action from responsible institutions to ensure the process of justice isn’t hampered” – Via Sucheta De[18]. Incidentally, there has not been any condemnation from Kavita Krishnan, Kanhaiya and other comrades. Generally, they come to roads or at least in New Delhi or within JNU campus, conduct some demonstration, but, now, they keep silence.

Anmol Ratan - facebook details

Anmol Ratan applies for bail and dubs the complaint is false: The PhD student who was allegedly raped by a fellow student from JNU recorded part of her statement before a metropolitan magistrate Tuesday 23-08-2016, while the accused, Anmol Ratan, moved a pre-arrest bail application in a sessions court[19]. His advocate Rajiv Mohan argued that the complaint was the result of a “political rivalry” as Ratan belonged to AISA, while the complainant was a part of the Collective and they had “ideological differences”. He also cited the forthcoming JNU elections as one of the reasons, given the “political rivalry” between the two outfits[20]. But, a girl-student, just like that give a complaint that “she has been raped by so and so”? On 20-08-2016, she was taken to medical examination and thereafter only, complaint registered. As last May 2016 also a student was arrested, the JNU intellectuals should think about the reality and change themselves, as they are answerable to the society. It is not that NDA or UDF is ruling ideology alone cannot be imposed on people or students for a long time.
