Madras High Court Judge amends his own Judgment after pressure from the Christian politicians, officialdom and clergy! Is India secular?

13-08-2019 – Christian institutions were highly unsafe for the future of their children: Justice S. Vaidyanathan accepts request to remove observations about Christian missionaries. The Madras High Court on Tuesday 20-08-2019, agreed to remove a contentious paragraph from one of its judgments since it was related to accusations faced by Christian missionaries of indulging in forcible religious conversions and supposed “general feeling” among parents, especially of girl children, that co-educational Christian institutions were highly unsafe for the future of their children[1]. Justice S. Vaidyanathan agreed to delete the relevant paragraph from his verdict in a case filed by a Madras Christian College (MCC) professor accused of sexually harassing girls during a study tour to Karnataka in January this year. The decision to delete was taken after the MCC counsel made a representation in open court on 20-08-2019, Tuesday and urged the court to remove the observations[2].

Para.32 of the Judgment

What the para 32 of the judgment said: The controversial paragraph read: “Before parting with the judgment, this Court feels it appropriate to point out that Christian missionaries are always on the source of attack in one way or the other and in the present era, there are several accusations against them for indulging in compulsory conversion of people of other religions into Christianity. Now, there is a general feeling amongst the parents of students, especially female students that co-educational study in Christian institutions is highly unsafe for the future of their children and though they impart good education, the preach of morality will be a million dollar question. As long as a religion is practised in streets in lieu of its worship places, like Temple, Mosque, Church, etc., such devastation, as in the present case, does occur and will be mushrooming.”

21-08-2019 – the Judge deleted the para no.32: Since the judge had dismissed the writ petition filed by the faculty challenging a show cause notice issued to him by the college management, the counsel said the subsequent observations added by the judge after dismissing the case were unnecessary and that they may not remain part of the judgment. The judge readily accepted the request. He, however, retained other observations wherein he had said that several women-centric enactments had been misused to teach a lesson to men in strained relationships. “This is the right time to think of suitable amendments in those laws, in order to safeguard the interest of the innocent,” the judge had said and directed the High Court Registry to mark a copy of his judgment to the Union Ministry of Law and Justice. The judge said[3], “When the court posed a question as to whether the court can remove Paragraph no.32 at this stage in the absence of any review petition – as the court becomes functuous officio after signing of the order – it was replied that there was no request for reviewing the entire order and a particular observation, which was general in nature was sought to be removed. Such removal will not in any way alter the findings/decisions of the court and therefore, there was no bar for this court to remove the Paragraph no.32, which was inapplicable to the present case on hand, especially when those points were not at all urged, canvassed, advanced or discussed by either of the counsel at the time of argument in the open court,” adding, “In view of the above submission and considering the fact that the general observation in Paragraph no.32 has been made by this court after the result portion, which will not at any cost affect efindings/substance/contents of the order, the said Paragraph no. 32 of the order is hereby deleted“, the judge added[4].

Days after Justice S. Vaidyanathan of the Madras High Court commented in an order that parents felt that Christian co-education institutions were highly unsafe for the future of girls, several groups, including the Tamil Nadu Bishops’ Council (TNBC), the Tamil Nadu Latin Bishops’ Council (TNLBC), the All India Democratic Women’s Association (AIDWA) and the Indian Christian Association of Tamil Nadu expressed concern over his remarks. What this AIDWA was doing when so many girl students of the MCC complained, news appeared in the media and they protested in the college? Were they not conscious about the chastity of the girls, standards of the college or the values of the Christians etc?

21-08-2019, the Christians and the Communists threaten and 21-08-2019, the Judge bends and mends!: The judge made the comments while dealing with a sexual harassment case involving a professor of the Madras Christian College. In a statement issued on 21-08-2019, Monday, TNBC and TNLBC termed two of Justice Vaidyanathan’s observations — that there were “several accusations against Christians for indulging in compulsory conversion of people of other religions into Christianity”; and that there was a “general feeling among the parents of female students that co-educational studies in Christian institutions is highly unsafe for the future of their children” — regrettable and unwarranted[5]. “First of all, the case is not in any way connected with the question of religious conversion. Therefore, the said observation on religious conversion was unwarranted,” said Rev. Dr. Antony Pappusamy, Archbishop of Madurai and president of TNBC and TNLBC[6]. Regarding the observation about female students being unsafe, Dr. Pappusamy said, “We wonder what the material and data placed before the honourable judge were, that led him to render such a finding. As such, from a cursory reading of the factual matrix in that particular case, we do not find any institutional material warranting such an observation.” He also again endorsed a copy to Ministry of Law and Justice for making necessary amendments[7]. This has created controversy among the legal circles[8].

Valentina, State president, AIDWA: In a statement, S. Valentina, State president, AIDWA, said that when the words from a judge could become a law, the baseless accusations of the judge could have a serious impact on the welfare of minorities in the current socio-political climate. “A judge could have a particular view on a subject or could adhere to a specific political ideology. But when the judge is delivering justice, the judge should be impartial and wear the glasses of the Indian Constitution,” she said. AIDWA urged that the comments be withdrawn. Can anybody ask S. Valentina , State president, AIDWA, as to whether she made such statement against the Judge as a woman or Christian or otherwise? Where was Valentine when those Christian professors were harassing the girls, touching their breasts and barging into their rooms? Is it OK for Valentine all such sexual acts?

The Indian Christian Association of Tamil Nadu said it was deeply hurt: The Indian Christian Association of Tamil Nadu said it was deeply hurt by Justice S. Vaidyanathan’s remarks in the sexual harassment case involving the Madras Christian College.“The sweeping statement that there is a general feeling among parents that co-educational study in Christian institutions is highly unsafe for the future of their children, especially female students, is based on conjectures and surmises, and the comments [should] be expunged from the judgment,” said Dr. Ravi Santosham, president, Indian Christian Association. “The judge’s statement about compulsory conversions is baseless and totally irrelevant to the merits of the case.”

CBCI oppose, Para.32 of the Judgment

Catholic bishops’ forum in Tamil Nadu, The National Council of Churches in India, etc cry foul[9]: Christian leaders said the judge’s comments were painful but they welcomed the court’s decision not to interfere with the decision of the college, which British Protestant missionaries established in 1837. “The remarks the judge made in the order are highly disappointing,” said Father L. Sahayaraj, deputy secretary of the Catholic bishops’ forum in Tamil Nadu. The comments could “damage the image of the Church and the reputation of its education intuitions,” the priest told ucanews.com. The National Council of Churches in India, a forum of Protestant and Orthodox churches in India, said the comments were hurtful[10]. “We are hurt and sorry for such remarks in the order,” said general secretary Asir Ebenezer. “Christians work with commitment and diligence. Unfortunately, we are blamed and our places portrayed as unsafe. It really makes us sad.” The Tamil Nadu Catholic Bishops’ Council in an official statement termed the observations “very unfortunate.” It said conversion or the safety of Christian schools were not the issues before the court. It was one “relating to sexual harassment by a professor and the college has taken necessary action against him without any excuse.” The council also said Christian educational institutions have “produced stalwarts” in India, including Hindus and Muslims. Prabhakar Tirkey, national president of the Rashtriya Isai Mahasang (National Federation of Christians), said the court seems to have forgotten that “not a single Christian has been convicted” for violating conversion laws in the history of India. He noted that Christian missionaries introduced English education some five centuries ago but when the British left India in 1947, the Christian population was less than 3 percent, and “now it is 2.3 percent.”

Vaiko converted Lazarus claim

Political and Minority bogey pressures: The MDMK chief, V. Gopalsamy, reportedly converted to Christianity, as being proclaimed by the Christian evangelist and propagandist C. Lazarasus, immediately came to question the judgment and his video has become viral.  Then on 19-08-2019, Geoge Kurian, Vice Chairman of National Commission for Minorities writes an open letter questioning the judgment.  On 21-08-2019, the Christians and the Communists threaten and 21-08-2019, the Judge bends and mends. Thus, wthin days, they could achieve what they wanted or decided. How is that then, eve rything is controlled by RSS, BJP and so on? Who rules India really? How much of Christian interference and how it works and all, have been proved again through this incidence.

Abhaya murder case

All rapists, pedophiles and other sexual charge sheeters are good: One can recall how the Sha Bano judgment was rescinded by bring another Act, just to placate Muslims and promote Muslim vote bank. So you can forget all the crimes committed by the Christians – the murder of Abhaya, rape of nun by Mulakal, rape of children i.e, Christian pedophiles, sexual harassment, and every thing. All have become good souls, only the affected have been unholy, satanic and dangerous.  The charged, accused and other sinned Cardinal, bishops, pastors and clergy have been redeemed.  An none could question the Christians whatever crime they committed. The Bishops, Churches and above all Vatican are supreme, the Indian judges, courts etc., are nothing. They obey only Holy Sea, Spirit, God etc., not the Indian Constitution, Acts and Rules made there-under.

The controversial Christian priest Ezra Shargunam and his land grabbing activities: In September 2017, when there was rumour about M. Karunanidhi, Ezra Sargunam gave interview to the media and certified that[1], “I met Karunanidhi, he is doing well….He looked at me……” It was surprise for many, as why a Christian priest should have done it, particularly, when Karunanidhi has been an atheist. Of course, Ezra’s role in political circles is considered as “broking”.  While Vaiko is criticized recently [this month, November 2017] for his “Christian” leanings and “crypto-Christian” activities, ironically, he himself dubbed Ezra Sargunam as “false-prophet” citing Bible[2]. He warned that people like him are tigers roaming with sheep’s skin. Thus, the role of Ezra has been intriguing on many accounts. Earlier in his book, he has openly recorded that there is nothing wrong in land grabbing[3]. That is whatever is done in the name of Jesus, it is allowed. Again, there have been court cases, involving him with land grabbing. In this context, what had happened 17 years ago in Gujarat, becomes important in the context.  Interestingly, the same Ezra Sargunam played a crucial role there. He was reportedly involved in a land grabbing case, where he tried to interfere and created “law and order problem.” As he had gone there as “the chairman of the Tamil Nadu Minority Commission,” the state authoties pointed out that he was out of jurisdiction and hence they could take action to arrest him for violations. Thus, he prepared to move bail to save his honour. The Gujarat Government also complained to the Government of Tamilnadu.

Karunanidhi asked Ezra Sargunam to return, as he exceeded limits: The Tamil Nadu Chief Minister, Mr. M. Karunanidhi, has asked the president of the Evangelical Society of India and chairman of the Tamil Nadu Minority Commission, Bishop Ezra Sargunam, to leave Gujarat and return home immediately, according to the Gujarat Minister of State for Home, Mr. Haren Pandya, here today [06-12-2000][4]. Mr. Pandya showed reporters a copy of the fax message sent by Mr. Karunanidhi to his Gujarat counterpart, Mr. Keshubhai Patel, urging the Bishop in Vyara hospital in Surat district, to return home[5]. The message also assured the Bishop that the issue of alleged attack on a church in Chhindia village of Vyara taluka, against which he launched an indefinite fast, could be taken up with an “appropriate authority” later. The Bishop was forcibly admitted to the Vyara Civil Hospital yesterday [05-12-2000] after his condition deteriorated.

Bishop Sundar Singh was commissioned as the new presiding Bishop of ECI.

Ezra was trying to instigate local Christians: The message, Mr. Pandya said, was in response to a request sent by the State Government pointing out that the Bishop was “trying to instigate” Christians in Chhindia village and creating a “law and order problem”. The Tamil Nadu Government was also informed that the chairman of its Minority Commission had “no jurisdiction” over Gujarat and had adopted a stance of non- cooperation with the authorities. Virtually blaming the Christians for the dispute over the church in the village, Mr. Pandya said the Government would take “stern action” against anyone found “instigating” people. It was a “deliberate scheme” of the Christians to “defame the BJP government in the State”, he claimed.

Christian plot to grab the land of a tribal: Denying knowledge of the involvement of the Vishwa Hindu Parishad in the incident of November 26 as alleged by the All-India Christian Council, the Minister said the land on which the “so- called church” was functioning actually belonged to Mr. Puniyabhai Ukadiabhai Kotwalia, a local tribal. Mr. Puniyabhai, who became a Christian some time ago, recently re-converted to Hinduism. On November 29, the Christian Council lodged a complaint with the Vyara police stating that a group of VHP activists “attacked the church” in Chhindia village on November 26 and “desecrated it”. Mr. Puniayabhai, meanwhile, accused Christian leaders of “forcibly entering” the “premises owned by him” and taking away the picture of a Hindu deity.

Conversion trick to create communal tension: While the Council spokesman, Mr. Samson Christian, said the piece of land was jointly owned by seven persons who together handed it over to the local Christian community for building a church in 1996, Mr. Pandya claimed that according to government records, Mr. Puniyabhai was sole owner of the land and inherited it from his father. The “church” was actually a room in his residence which he had “allowed local Christians to use as a prayer hall,” Mr. Pandya said. Mr. Christian had accused the local police of working hand-in- glove with the VHP in attacking the church in the presence of senior government officials including the District Collector and the District Superintendent of Police. Mr. Pandya said the Revenue Department gave Mr. Puniyabhai ownership of the land in June, 1992, as he was cultivating it since 1975. Under the Tenancy Act, he had no authority to sell or re-allocate it to anyone else without the prior permission of the Government and there was no question of his giving the land for construction of a church. But after Mr. Puniyabhai became a Christian in 1995, one of the rooms was used by local Christians as a prayer hall. He re-converted to Hinduism six months ago and since then has refused permission for the room to be used as a church.

Land grabbing Ezra’s style carried on in Gujarat: Contrary to Mr. Samson Christian’s claims, Mr. Pandya said a group of Christians forcibly entered the room on November 26 and removed the picture of a Hindu deity. On a complaint filed by Mr. Puniyabhai, the Vyara civil court issued a stay on December 1 against the use of the land by either sides and fixed the hearing on December 12. The issue could have been resolved earlier but for the adjournment sought twice on November 30 and December 4 by the local Christians on its hearing, Mr. Pandya claimed. He alleged that Bishop Sargunam went on an indefinite fast only after the civil court granted the stay. The Christian Council also filed a petition in the Gujarat High Court against the stay granted by the Vyara civil court. Mr. Pandya also refuted the Council’s claim that 200 Christians had migrated from the village after November 26. The Vyara social justice committee chairman along with some other officials visited the village and found that all the people were staying in their respective houses, he said. No migration had taken place as claimed by Mr. Christian, he stated and pointed out that in the village with a population of 1,500, over 75 per cent were Hindus and the rest Christians.

Local Court granted bail for Ezra, thus escaped from arrest[6]: The Vyara civil court today [14-12-2000] granted anticipatory bail to Bishop Ezra Sargunam, the national president of the Evangelical Church of India, but refused him permission to enter any place within its jurisdiction, which include Chhindia village in south Gujarat, where a church of his denomination was allegedly attacked on November 26, 2000. The Bishop, who is also the chairman of the Tamil Nadu Minority Commission, had filed the anticipatory bail following a criminal complaint filed against him and a few others by the “owner” of the piece of land on which the church stood, Mr. Punyabhai Kotwalia, for allegedly “trespassing” on his property[7]. The Bishop had launched an indefinite fast in front of the church on November 29 demanding restoration of the church, which the Christians claimed was desecrated during the attack and converted into a temple. The Vyara civil court, while granting a stay on December 1 on Mr Punyabhai’s petition that the land was his “personal property,” had also directed the Bishop to stay away from Vyara taluka. The Bishop, who is still here meeting with other Christian leaders, had made it clear that he would take a decision on the Tamil Nadu Chief Minister, Mr. M. Karunanidhi’s message to return to Chennai only “in consultation with the leaders of the secular forces.”

Ezra indulged in objectionable activities: The Gujarat Minister of State for Home, Mr. Haren Pandya, when asked about the Vyara civil court’s order, said the State Government would ensure that the court order was “strictly implemented” hinting that it would not hesitate to arrest the Bishop if he made any attempt to return to Vyara or Chhindia. The State Home Secretary, Dr V. V. Rama Subba Rao, has written to the Tamil Nadu Chief Secretary, informing him about the “objectionable activities” of the Bishop in the State. Like the Chief Minister, Mr. Keshubhai Patel, who wrote to his Tamil Nadu counterpart twice requesting him to recall the Bishop, Dr. Subba Rao has also requested the Chief Secretary to take immediate steps to ensure that the Bishop stopped “interfering” with the law and order situation in the State[8]. In fact, his refusal to leave, created tension in the area[9]. Meanwhile, the State Government has decided to make elaborate security arrangements in the south Gujarat districts to ensure peace during the Christmas and New Year celebrations. At a meeting of the district collectors and district superintendents of police of Surat, Bulsar, Navsari and Dangs districts convened here today by Mr. Pandya and Dr. Subba Rao, it was decided to deploy adequate number of state reserve police and anti-riot Rapid Action Force personnel in the four districts to assist the local police and home guards to maintain peace during the celebrations.

PTI reports from Surat: The sessions court today banned the entry of Bishops Ezra Sargunam and Fr. Raive Ishudas of Chennai into the Vyara sub- division, without the written permission from the court. According to the conditions imposed by the court on the Bishops, the orders would be applicable till the chargesheet was filed against them. The court allowed anticipatory bail applications by the Bishops and dismissed the criminal application filed by Shankarbhai Gamit of Vyara. The Vyara police was directed to enlarge the two Bishops on bail on their furnishing a solvent surity of Rs. 5000 with a personal bond for the like sum each in the event of their arrest in an offence registered by the Vyara police station.  The same news was also reproduced by the Catholic news agency it its own way[10]. “An Indian court has banned a Protestant bishop from entering the area of a disputed chapel in a ruling the bishop says was politically motivated to harass Christians….. Bishop Sargunam, vice chairman of the Minorities Commission of the southern Indian state of Tamil Nadu, said he left Gujarat after state authorities refused to meet him…….. The Protestant bishop told UCA News that he had to leave the area because of the state government´s partisan approach toward Christians. Anti-Christian attacks in Gujarat are “State-sponsored vandalism,” he said. More than 100 attacks against Christians have been reported in Gujarat in the last two years.” Thus, the persecution myth went on in their own way[11].

Alleged conversion of Vaiko to Christianity, the revelation of controversial evangelist Mohan Lazarus and denial by the Periyarist V. Gopalsamy!

Murderers, dupers and unbelievers converted to Christianity!: Many Christian pastors have been accused of forcefully converting people of other faith, sometimes with stories of the eternal fire of damnation and sometimes with the lure of freebies[1]. But what came as a shock to many was the news of MDMK chief Vaiko’s conversion to Christianity, thus reported Asianet Newsable[2]. But, the reality has been none bothered about it, as Indians know the religious deceptions, pious frauds and divine scams have been going on behind such propaganda. As for as people of Tamilnadu are concerned, they know very well popular and notorious ones like A. V. M. Rajan[3] to Auto Shankar[4] (1954-1995) were converted to Christianity. Actually, Rajan was converted reportedly, as he was having some financial problems. As for as Auto Shankar is concerned, it is well knon that he was a hard-core criminal, rapist and killer of several women, thus, he was hanged. Ironically, the Christians caught hold of him before hanging, converted and promised heaven! It is not known, as to whether the inhuman murderer had gone to hell or “Christian heaven”! In any case, the conversion has not been any grace or honour brought to them or to their religion Christianity.

AVM Rajan and Auto Shankar converted

The conversion news coming out through Social media and media also: Now, news has come out in the mdia explicitly that Vaiko has been converted to Christianity and it has been revealed by one evangelist Mohan C. Lazarus. The videos revealing the conversion and Vaiko attending midnight mass and appreciating Christianiy like a preacher quoting Biblical verses have been in circulation for the last two weeks. Therefore, it was neccecitated Vaiko to clarify his position. The evangelist has been controversial with his rude way of criticizing Modi and ruling BJP. In vernacular media, his controversial acts have also been reported, but, he denied. Now, also, no secularist or Dravidian ideologist has come forward to criticize, analyze or condemn the conversion, alleged conversion, denial etc., in the context.

Mohan Lazarus claims Vaiko family converted

Mohan C Lazarus declares that Vaiko has been converted and he is a Christian!: Vaiyapuri Gopalsamy, also known as Vaiko is the founder and General Secretary of the Marumalarchi Dravida Munnetra Kazhagam (MDMK), a political party active mainly in the state of Tamil Nadu. The claim of Vaiko converting to Christianity was first made by one of Tamil Nadu’s prominent evangelists Mohan C Lazarus. He also claimed in a video that is being widely circulated on social media that Vaiko was reading the Bible twice a day and regularly visits the Church along with his family. They have been baptized. Lazarus also said that Vaiko’s entire family had converted to Christianity. “His daughter and son-in-law are Christians. They are in the US, and every Sunday, they do the service of God. His wife is a Christian. Since he is in public life, he is not able to announce his new faith. He told me that he was reading Bible two times a day and asked me how to pray and I taught him,” Lazarus claimed in the video[5]. He could have produced the baptism certificate issued for Vaiko.

Can any evangelist declare that any Dravidian leader has been converted and become a Christian?: Responding to a recent video of Lazarus, in which he states that Vaiko and his family have undergone baptism and converted to Christianity, MDMK deputy general secretary Mallai Sathya said that Vaiko has not made any announcement of getting converted into Christianity[6]. How then, Lazarus could declare so openly? Speaking to News Today, he said that Vaiko is a secular leader, who is genuinely interested in knowing about all religions. “He reads Quran, Bible and Bhagavad Gita to know about them and gain knowledge. This does not mean that he has converted to one particular religion. He is an atheist leader and will continue to be so,” he added[7]. Sathya said that people use his name for their own benefits and we do not take this seriously.  ‘We cannot go behind everyone who uses Vaiko’s name,’ he added. According to Lazarus, Vaiko’s daughter and son in law who live in US are engaged in Christian evangelist work.

Vaiko’s reply has not been straight to deny: However, Vaiko has refuted Lazarus’ claims, saying that he hasn’t converted. “I am not a Christian. I respect all religions and my daughter-in-law has a pooja room in which you can see images of all Gods,” he told The Hindu. It was a result of his over-enthusiasm. It’s me and my brother who regularly contribute to the maintenance of the Vinayagar temple in my village,” he further said. He need not explain in this way apologetically, instead of refuting directly. Vaiko said that he had taken up the issue with Lazarus himself as such statements could have serious consequences[8]. He clarified that his daughter had married a Christian and there was no truth in the claim of Mr. Lazarus about others[9]. In Tamil media, he reportedly said that the speech of Lazarus would affect the political condition of the southern districts. So can Vaiko claim that even after becoming a Christian, instead of telling about her, why he says, that, . “……….my daughter-in-law has a pooja room in which you can see images of all Gods,”? Vaiko has been an open supporter of LTTE and had also made a trip to Eelam at the height of the LTTE’s war with Sri Lankan Army which has landed him into a lot of trouble over the years. He was arrested in 2010 for a sedition case filed by DMK. The crypto Christians are as dangerous as the false evangelists spreading satanic news and corrupting the Indian society.

Vaiko’s pro-Christian activities and support: In July 2017, Vaiko led MDMK and PMK objected to keeping engraved Bhagawat Gita alongwith the wooden statue of Abdul Kalam playing veena in Kalam Memorial constructed by the Defense Research and Development Agency[10]. Vaiko insisted that Gita should be replaced with Tirukkural. Ironically giving all details, Deepak Aswale concludes that it seems the controversy over communal politics and Vaiko is certainly not coming to end[11]. Vaiko had not only brought a private member’s bill in parliament to give reservation for Dalit Christians[12], but also been campaining for the cause[13]. With his collegue Thiruma also he has bee doing that, though, legally, it is not possible[14]. Thus, knowingly why he has bee doing such propaganda has been intriguing. Here, the double-game of all the Christian missionaries, dalit groups, secular politicians, atheist grups etc., as such reservation is legally impossible, as the Presidential Order 1950 is meant for Hindus.
